Quenzler, by awl ._ , ~' through its attorney, Susan J. Hartman, Esquire, respectfully states the following: 1. Mary K. Quenzler ("Decedent") died, a resident of Cumberland County, Pennsylvania on February 7, 1991, leaving a will dated May 7, 1976, which was probated in the office of the Register of Wills of Cumberland County, Pennsylvania, docketed to Estate No. 21-91-208. A copy of the Will is attached hereto as Exhibit "A". 2. Decedent, in Item III of her will, gave all of her residuary estate to Dauphin Deposit Trust Company, now M&T Bank, Trustee, to be held in trust for the benefit of Mary Kay Quenzler for her life with remainder to Decedent's nieces, Catherine Hershey, Carol Warnick and Jane Losh, in equal shares, per stirpes, with payments of net income to be paid to her for life, with the power to invade the principal in the Trustee's discretion. 3. M&T Bank is the entity which currently serves as Trustee. 4. The Decedent's residuary estate consisted of the real estate situate at 1938 High Street, Camp Hill, Pennsylvania valued at $52,000.00 and Personal Property valued at $8,566.38. A copy of Decedent's Inheritance Tax Return is attached hereto as Exhibit "B". 5. The Trust currently consists solely of real estate located at 1938 High Street, Camp Hill, Cumberland County, Pennsylvania, valued at $129,000 to $135,000. A copy of a real estate evaluation is attached hereto as Exhibit "C". 6. A final accounting of the Trust under the Will of Mary K. Quenzler is incorporated herein and attached hereto as Exhibit "D" 7. Mary Kay Quenzler, beneficiary of the Trust, is a 63 year old individual who suffers from a mental disability consisting of mental retardation and major depressive disorder. She is currently receiving Social Security benefits, medical assistance, food stamps and county assistance. She has never been employed. 8. Given the prohibitive costs of her prescription medications and anticipated increases in her medical costs, as well as the necessity of maintaining the assistance given her through county waiver funding, it is desirable to reform the Trust to create a Special Needs Trust to supplement, rather than supplant, benefits for her basic needs. This would fulfill the intention of the Testatrix in providing for Ms. Quenzler's care for the duration of her life while optimally preserving the trust funds for her benefit and that of the remainder beneficiaries. 9. There are no funds available to maintain the property located at 1938 High Street, Camp Hill. Sale of the real estate would create a fund which would disqualify Ms. Quenzler from receiving the medical assistance and other benefits she currently receives. 10. Petitioner requests that the Court order the reformation of the trust created by Decedent's will for the benefit of Mary Kay Quenzler to establish a Special Needs Trust, which would allow her to sell the real estate to create a fund from which she could receive a small payment to Supplement her current income while enabling her to remain eligible for medical assistance, food stamps and county assistance programs. 11. Petitioner requests that the terms of Item III (B) of Decedent's will be reformed by the addition of the following: "All the rest, residue and remainder of my property and estate, both real and personal, of whatsoever kind and wheresoever situate, of which I die seized or possessed, I give, devise and bequeath unto the Mary Kay Quenzler Special Needs Trust and my trustee, Dauphin Deposit Trust Company, now M&T Bank, in trust in accordance with the terms and conditions set forth in an instrument known as the "Mary Kay Quenzler Special Needs Trust" incorporated herein by reference." 12. A copy of the proposed Mary Kay Quenzler Special Needs Trust is attached hereto, made a part hereof by reference and marked as Exhibit "E". 13. 20 Pa.C.S. section 711(2) provides, in relevant part: [T]he jurisdiction of the court of common pleas over the following shall be exercised through its orphans' court division: (2) Testamentary trusts. -The administration and distribution of the real and personal property of testamentary trusts, and the reformation and setting aside of any such trusts, whether created before or after the effective date of this chapter.... 14. 20 Pa.C.S. section 7740.1(b) of the Uniform Trust Act provides, in relevant part: Modification or termination of non charitable irrevocable trust by consent...(b) consent by beneficiaries with court approval. -Anon charitable irrevocable trust may be modified upon the consent of all the beneficiaries only if the court concludes that the modification is not inconsistent with a material purpose of the trust... 15. The terms of the Special Needs Trust are consistent with the terms of the Will, and with the Decedent's intentions to provide for the needs of Mary Kay Quenzler for the duration of her life and also the benefit Decedent's nieces. 16. The proposed modification of the Trust is not inconsistent with a material purpose of the trust and is in the best interest of both the life beneficiary and the remainderwomen.. 17. M&T Bank, successor trustee to Dauphin Deposit Bank and Petitioner herein, also seeks to be removed as trustee. 18. The ARC Community Trust of Pennsylvania, anon-profit corporation located at 1004 West 9t" Avenue, King of Prussia, PA 19406 has agreed to be appointed as successor trustee to M&T Bank. 19. The consents of all of the beneficiaries of the said Trust are attached to this petition as Exhibit "F". WHEREFORE, Petitioner respectfully requests that this Court enter an Order reforming the Trust under Item III of the Will dated May 7, 1976 of Mary K. Quenzler, deceased, and establishing a Special Needs Trust for the benefit of Mary Kay Quenzler, with The Arc Community Trust of Pennsylvania serving as successor Trustee to M&T Bank.
