SANSOUCIE, : CIVIL ACTION - LAW Defendant : IN CUSTODY PETITION FOR CUSTODY AND NOW, TO WIT, this day of X2010 comes the Plaintiff, Jennifer Lynn Neugebauer, by and through her attorney, Jane M. Alexander, Esquire, and files this Complaint of which the following is a statement: 1. Plaintiff is Jennifer Lynn Neugebauer, an adult individual residing at 320 Rosemont Avenue, Borough of New Cumberland, Cumberland County, Pennsylvania 17070. 2. Defendant is David V. Sansoucie, an adult individual residing at 1850 Crestlyn Avenue, York, York County, Pennsylvania 17403. 3. Plaintiff and Defendant are the natural parents of the minor child, born Ethan D. Sansoucie, age 7, born December 6, 2002. 4. Plaintiff and Defendant were never married. 5. There is no prior court order for custody of this child. Parties have never sought a court order or signed an agreement regarding custody and visitation of the child. 6. Plaintiff seeks primary legal custody and primary physical custody of the subject child with the Defendant having scheduled periods of custody for purpose of visitation. 7. The present verbal agreement is that Defendant has the child on alternating weekends and alternating holidays. 8. Plaintiff is seeking a court order which stipulates firm dates and times for visitation and provisions as to transportation and communication. 9. The relationship of the Plaintiff to the child is that of natural mother. 10. The relationship of Defendant to the child is that of natural father. 11. During the past five (5) years the child has resided at the following addresses with Plaintiff. Plaintiff has not participated as a party or witness, or in another capacity, in other litigation concerning the custody of the child in this or another court. 13. Plaintiff has no information of any custody proceedings concerning the child pending in any other court of this Commonwealth. 14. Plaintiff does not know of a person not a party to the proceedings who has physical custody of the child or claims to have custody or visitation rights with respect to the child. 15. The best interest and permanent welfare of the child will be best served by granting the relief requested because the Plaintiff has appropriate living space for the child and has always been the primary caregiver of the child. WHEREFORE, Plaintiff requests your Honorable Court to grant an order giving the Plaintiff primary legal custody and primary physical custody of the subject child with scheduled periods of custody for Defendant on alternate weekends and for holidays and special events.
