COMPLAINT
AND NOW, come the Plaintiffs, Stephanie L. Sipe and Gary Sipe, her husband, by and
through their attorneys, HANDLER, HENN1NG & ROSENBERG, LLP, by Matthew S. Crosby,
Esq., and make the within Complaint against the Defendants, Gregory L. Ryan and Federal Express
Corporation, as follows:
1. Plaintiff, Stephanie L. Sipe, is an adult individual currently residing at 107 Howard
Street, Enola, Cumberland County, PA 17025.
2. Plaintiff, Gary Sipe, is an adult individual currently residing at 107 Howard Street,
Enola, Cumberland County, PA 17025.
3. Defendant, Gregory L. Ryan, is an adult individual currently residing at 359 Orenda
Circle, Westfield, NJ 07090.
4. Defendant, Federal Express Corporation, is a corporation currently doing business
at the address of c/o Corporation Systems, 1635 Market St., Ph![ladelphia, PA 17057; Defendant,
Federal Express Corporation, regularly conducts business within the Commonwealth of
Pennsylvania and within Cumberland County, Pennsylvania.
5. At all times material hereto, Plaintiff, Stephanie lo. Sipe, was the owner and operator
of a 1995 Saturn SL2, bearing Pennsylvania Registration Plate Number ESH4092 (hereinafter
"Plaintiff's vehicle.")
6. At all times material hereto, Defendant, Gregory L. Ryan, was the operator ofa 1995
International, truck, bearing the Tennessee Registration Plate Number 15055HY, owned and/or
leased by or through his employer, Defendant, Federal Express Corporation (hereinafter
"Defendant's vehicle").
7. At all times material hereto, Defendant, Gregory L. Ryan, was an agent, servant,
and/or employee of Defendant, Federal Express Corporation, and was acting within the scope of said
employment.
8. On or about July 10, 2002, at approximately 10:20 am, Plaintiff, Stephanie L. Sipe,
was traveling northbound on Interstate 81, in the right lane of travel, in Hampden Township,
Cumberland County, Pennsylvania.
9. On or about July 10, 2002, at approximately 10:20 am, Defendant, Gregory L. Ryan,
was traveling northbound on Interstate 81, in the left lane of travel, in Hampden Township,
Cumberland County, Pennsylvania.
10. At approximately that same time and place, Defendant, Gregory L. Ryan, suddenly
and without warning, began changing lanes, and violently struck the Plaintiffs' vehicle.
11. At the time of this collision, Plaintiff, Stephanie L. Sipe, was insured under a motor
vehicle policy through Erie Insurance Company. Said policy provided for, and entitled Plaintiffs to,
full-ton rights.
12. At the time of this collision, Plaintiff, Stephanie L. Sipe, was 36 weeks pregnant.
13. As a direct and proximate result of the negligence of Defendants, Gregory L. Ryan
and Federal Express Corporation, the Plaintiff, Stephanie L. Sipe, sustained serious and extensive
injuries as set forth more specifically below.
COUNT I - NEGLIGENCE
STEPHANIE L. SIPE v. GREGORY' L. RYAN
14. Plaintiff, Stephanie L. Sipe, herein incorporates paragraphs 1 through 13 of this
Complaint as if set forth below.
15. The occurrence of the aforesaid collision and the resultant injuries to Plaintiff,
Stephanie L. Sipe, were caused directly and proximately by the negligence of Defendant, Gregory
L. Ryan, generally artd more specifically as set forth below:
(a) In operating a motor vehicle inattentively;
(b) In failing to be reasonably vigilant to observe the position of Plaintif?s
vehicle on the roadway;
(c) In failing to properly and adequately observe the traffic conditions then and
there existing;
(d) In operating Defendant's vehicle at an excessive rate of speed under the
circumstances; in violation of 75 Pa. C.S.A. § 3361.
(e) In failing to have Defendant's vehicle under proper and adequate control;
(f) In failing to keep a look-out for other vehicles lawfully on the road;

In failing to operate Defendant's vehicle under proper and adequate control
so that he could have moved from one lane of traffic to the other with
reasonable safety, in violation of 75 Pa. C.S.A. § 3334;
In attempting to make a lane change without giving an appropriate signal of
his intention to do so, in violation of 75 Pa. C.S.A. § 3334;
In failing to yield the right-of-way to traffic already upon the highway;
In turning in such a manner as to endanger the safety of other vehicle
operators on the highway;
In attempting to make a lane change without first ascertaining that such
movement could be made safely, in violation of 75 Pa. C.S.A. 83309;
In failing to keep a proper lookout for approaching vehicles;
In failing to stay to the left of the PlaintifFs vehicle until safely clear of said
vehicle, in violation of 75 Pa. C.S.A. § 3303;
In driving in a careless manner by disregarding the safety of other drivers
when switching lanes without observing,, the traffic in the adjacent lane, in
violation of 75 Pa. C.S.A. § 3714;
In failing to keep Defendant's vehicle within the proper lane of travel, in
violation of 75 Pa. C.S.A. § 3309;
In driving in a careless manner, in violation of 75 Pa. C.S.A. § 3714; and
In failing to operate said vehicle under proper and adequate control in order
that he could avoid striking PlaintifFs w:hicle.
16. As a direct and proximate result of the negligence of Defendant, Gregory L. Ryan,
Plaintiff, Stephanie L. Sipe, sustained severe injuries, including, but not limited to, injuries to her
lumbar spine, lower-back and buttock pain, as well as leg pain, surgical scarring and increased
anxiety with respect to the healthy birth of her baby.
17. As a direct and proximate result of the negligence of Defendant, the Plaintiff,
Stephanie L. Sipe, has suffered great physical pain, discomfbrt, and mental anguish, and will
continue to endure the same for an indefinite period of time in the future, to her great physical,
emotional, and financial detriment and loss.
18. As a direct and proximate result of the negligence of Defendant, the Plaintiff,
Stephanie L. Sipe, has suffered lost wages and will in the future continue to suffer a loss of income
and/or loss of earning capacity.
19. As a direct and proximate result of the negligence of Defendant, the Plaintiff,
Stephanie L. Sipe, has been compelled, to effect a cure for the atbresaid injuries, to spend money for
medicine and/or medical attention, and will be required to expend money for the same purposes in
the future, to her great detriment and loss.
20. As a direct and proximate result of the negli[gence of Defendant, the Plaintiff,
Stephanie L. Sipe, has been, and probably will in the future be, hindered from attending to her daily
duties, to her great detriment, loss, humiliation, and embarrassment.
21. As a direct and proximate result of the negligence of Defendant, Plaintiff, Stephanie
L. Sipe, has suffered a loss of life's pleasures, and will continue to endure the same in the future, to
her great detriment and loss.
22. Plaintiff, Stephanie L. Sipe, believes and, therefore, avers that her injuries are serious
and permanent in nature.
WHEREFORE, Plaintiff, Stephanie L. Sipe, seeks damages from Defendant, Gregory L.
Ryan, in an amount in excess of the compulsory arbitration [imits of Cumberland County and
demands a trial by jury.
COUNT II - VICARIOUS LIABILITY
STEPHANIE L. SIPE v. FEDERAL EXPRESS CORPORATION
23. Plaintiff, Stephanie L. Sipe, herein incorporates paragraphs I through 22 of this
Complaint as if set forth below.
24. At all times material to this action, Defendant, Gregory L. Ryan, was an agent,
servant, and/or employee of Defendant, Federal Express Corporation.
25. The occurrence of the aforementioned collision and all of the resultant injuries to
Plaintiff, Stephanie L. Sipe, are the direct and proximate result of the negligence, carelessness,
and/or recklessness of Federal Express Corporation's employee, Gregory L. Ryan.
26. The aforementioned negligent, careless, and/or reckless conduct of Defendant,
Gregory L. Ryan, occurred while acting in, and upon, the business of Defendant, Federal Express
Corporation, and within the course and scope of his employment with said Defendant.
27. Defendant, Federal Express Corporation, is vicariously liable for the extensive and
personal injuries suffered by Plaintiff, Stephanie L. Sipe, whi[ch include, but are not limited to,
injuries to her lumbar spine, lower-back and buttock pain, as well as leg pain, surgical scarring and
increased anxiety with respect to the healthy birth of her baby.

28. As a direct and proximate result of the negligence of Defendant, the Plaintiff,
Stephanie L. Sipe, has suffered great physical pain, discomfi~rt, and mental anguish, and will
continue to endure the same for an indefinite period of time in the future, to her great physical,
emotional, and financial detriment and loss.
29. As a direct and proximate result of the negligence of Defendant, the Plaintiff,
Stephanie L. Sipe, has suffered lost wages and will in the future continue to suffer a loss of income

30. As a direct and proximate result of the negligence of Defendant, the Plaintiff,
Stephanie L. Sipe, has been compelled, in order to effect a cure for the aforesaid injuries, to spend
money for medicine and/or medical attention, and will be required to expend money for the same
purposes in the futura, to her great detriment and loss.
31. As a direct and proximate result of the negligence of Defendant, the Plaintiff,
Stephanie L. Sipe, has been, and probably will in the future be, !hindered from attending to her daily
duties, to her great detriment, loss, humiliation, and embarrassment.
32. As a direct and proximate result of the negligence of Defendant, the Plaintiff,
Stephanie L. Sipe, has suffered a loss of life's pleasures, and will continue to endure the same in the
future, to her great detriment and loss.
33. Plaintiff, Stephanie L. Sipe, believes and, therefore, avers that her injuries are serious
and permanent in nature.
34. Defendant is vicariously liable for both the non-economic and the economic damages
Plaintiff, Stephanie L. Sipe, has suffered and will continue to endure for an indefinite period of time
in the future.

WHEREFORE, Plaintiff, Stephanie L. Sipe, seeks damages from Defendant, Federal
Express Corporation, in an amount in excess of the compulsory arbitration limits of Cumberland
County and demands a trial by jury.
COUNT III -LOSS OF CONSORTIUM
GARY SIPE v. GREGORY L. RYAN
35. Paragraphs 1 through 34 are incorporated herein as if set forth at length.
36. At all times material to this action, Plaintiffs, Gary Sipe and Stephanie L. Sipe,
were husband and wife.
37. As a direct and proximate result of Defendant's negligence, the Plaintiff, Gary
Sipe, has suffered a loss of consortium, society, and comfort fi'om his wife, Stephanie L. Sipe~
and he will continue to suffer a similar loss in the future.
38. As a direct and proximate result of Defendant's negligence, the Plaintiff, Gary
Sipe, has been compelled, in order to effect a cure for his wife's injuries, to expend money for
medicine and medical attention and will be required to expend money for the same purposes in
the future, to his great detriment and loss.
WHEREFORE, Plaintiff, Gary Sipe, seeks damages :['rom the Defendant, Gregory L.
Ryan, in an amount in excess of the compulsory arbitration Ii,nits of Cumberland County and
demands a trial by jury.
COUNT IV -LOSS OF CONSORTIUM
GARY SIPE v. FEDERAL EXPRESS CORPORATION
39. Paragraphs 1 through 38 are incorporated herein as if set forth at length.
40. At all times material to this action, Plaintiffs, Gary Sipe and Stephanie L. Sipe,
were husband and wife.
41. As a direct and proximate result of Defendant's negligence, the Plaintiff, Gary
Sipe, has suffered a loss of consortium, society, and comfbrt from his wife, Stephanie L. Sipe,
and he will continue to suffer a similar loss in the future.
42. As a direct and proximate result of Defendant's negligence, the Plaintiff, Gary
Sipe, has been compelled, in order to effect a cure for his wife's injuries, to expend money for
medicine and medical attention and will be required to expend money for the same purposes in
the future, to his great detriment and loss.
WHEREFORE, Plaintiff, Gary Sipe, seeks damages fi'om the Defendant, Federal
Express Corporation, in an amount in excess of the compulso~ arbitration limits of Cumberland
County and demands a trial by jury.

TO THE HONORABLE JUDGES IN THE UNITED STATES DISTRICT
COURT FOR THE MIDDLE DISTRICT OF PENNSYLVANIA:
Defendants, Gregory L. Ryan and Federal Express Corporation, by and
through their attorneys, Rawle & Henderson LLP, respectfully avers as follows:
1. Plaintiffs commenced a civil action again:st defendants in the Court of
Common Pleas of Cumberland County, Pennsylvania,, by writ of summons on or
about June 7, 2004, as a result of a July 10, 2002 rnotor vehicle accident. See
Exhibit "A" - Plaintiffs' writ of summons.
2. On or about July 2, 2004 defendants filed a Praecipe for Rule on
plaintiffs to file a complaint in the Court of Common Pleas for Cumberland
County, Pennsylvania. See Exhibit "B" - Praecipe for rule on plaintiffs to file a
complaint and rule to file a complaint.
3. On or about July 6, 2004, defendants served plaintiffs with the rule to
file complaint. See Exhibit "B" - Praecipe for rule on plaintiffs to file a complaint
and rule to file a complaint.
4. On July 21, 2004, defense counsel received a copy of plaintiffs'
complaint. See Exhibit "C" - Plaintiffs' complaint.
5. In the complaint, plaintiffs demands damages in an amount in excess
of "the compulsory arbitration limits of Cumberland County". Specifically,
plaintiffs allege, inter alia, that plaintiff, Stephanie L. Sipe, sustained the following
injuries as a result of the motor vehicle accident at issue herein:
16. As a direct and proximate result of the negligence of
Defendant, Gregory L. Ryan, Plaintiff, Stephanie L. Sipe, sustained
severe injuries, including, but not limited to, injuries to her lumbar
spine, lower-back and buttock pain, as well as leg pain, surgical
scarring and increased anxiety with respect to the healthy birth of her
baby.

17. As a direct and proximate result of the negligence of
Defendant, the Plaintiff, Stephanie L. Sipe, has suffered great physical
pain, discomfort, and mental anguish, and will continue to endure the
same for an indefinite period of time in the future, to her great
physical, emotional, and financial detriment and ]loss.
18. As a direct and proximate result ,of the negligence of
Defendant, the Plaintiff, Stephanie L. Sipe, has. suffered lost wages
and will in the future continue to suffer a loss of income and/or loss of
earning capacity.
19. As a direct and proximate result of the negligence of
Defendant, the Plaintiff, Stephanie L. Sipe, has: been compelled, to
effect a cure for the aforesaid injuries, to spend money for medicine
and/or medical attention, and will be required to e, xpend money for the
same purposes in the future, to her great detriment and loss.
20. As a direct and proximate result of the negligence of
Defendant, the Plaintiff, Stephanie L. Sipe, has been, and probably
will in the future be, hindered from attending to her daily duties, to
her great detriment, loss, humiliation and embarrassment.
21. As a direct and proximate result of the negligence of
Defendant, the Plaintiff, Stephanie L. Sipe, has suffered a loss of life's
pleasures, and will continue to endure the same in the future, to her
great detriment and loss.
22. Plaintiff, Stephanie L. Sipe, believes and, therefore, avers
that her injuries are serious and permanent in nature.
See Exhibit "C"- plaintiffs' complaint, ¶¶ 16-22.
6. Based upon a fair reading of the complaint,, plaintiffs have set forth a
claim in which an amount in excess of the jurisdictional limit of $75,000, exclusive
of interest and costs, may be at stake.
7. At all times material hereto, defendant, Federal Express is and was a
Delaware corporation with its principal place of business located in Memphis,
Tennessee.

8. At all times material hereto, defendant, Gregory L. Ryan, is a citizen
of New Jersey residing in Westfield, New Jersey.
9. Plaintiff, Stephanie L. Sipe as well as her husband Gary Sipe are
citizens of the Commonwealth of Pennsylvania, and they reside at 107 Howard
Street, Enola, Cumberland County, Pennsylvania. See Exhibit "C" - plaintiffs'
Complaint, ¶¶ 2-3.
10. Diversity of citizenship within the meaning of 28 U.S.C. § 1332, exists
between plaintiffs and defendants since:
(a) Plaintiffs are citizens and residents of the Commonwealth of
Pennsylvania; and
(b) Defendants are not citizens of the Commonwealth of
Pennsylvania.
11. Furthermore, diversity of citizenship exis~ted at the time the action
sought to be removed was commenced and continues through the time of filing of
this notice, such that defendants are entitled to removal pursuant to 28 U.S.C.
§ 1441, as amended, and 28 U.S.C. §1446.

WHEREFORE, defendants, Gregory L. Ryan and Federal Express
Corporation, pray that the above-captioned action now pending in the Court of
Common Pleas of Cumberland County, Pennsylvania, be removed there from to
this Honorable Court.
