RELEASE BY SURVIVING SPOUSE
I, David A. Sheeley, husband of Janice I. Sheeley a/k/a Janice I. Boyer, deceased,
late of 25 Bently Place, Carlisle Borough, County of Cumberland, the Commonwealth of
Pennsylvania, in consideration of the agreement I had with my late wife that if she should
die all her property, real, personal and intangible, would be distributed according to the
Will she had written prior to our marriage in December 1999. My said late wife and I
separated in 2001 and have since that time lived separate and apart. Thus, in
consideration of my promises, I hereby release, exonerate, and discharge the Estate of
Janice I. Sheeley a/k/a Janice I. Boyer from any and all liability and accountability to me,
as surviving spouse, and I consent that said Executrice may have a decree entered
discharging her from any and all claims, demands, liability and accountability to me as
surviving spouse including my right to take against the Will without further accounting.
I waive the issue and service on me of a citation to attend the judicial settlement
of the accounts of said Executrice, or any other proceedings taken by them in the Office
of the Register of Wills or in the Orphan's Court of the County of Cumberland, the
Commonwealth of Pennsylvania pertaining or relating to the estate of decedent and that if
appropriate, the beneficiaries of the Will of my late wife may proceed with a Family
Agreement to resolve the estate without having me join in the same.
