TO THE HONORABLE, THE JUDGES OF THE SAID COURT:
The Petition of Carol J. Livingston respectfully represents:
1. The alleged incapacitated individual is Ian Michael
Weidenhammer, hereinafter referred to as Ian, who is an adult
individual, born March 30, 1990, who resides in a group home at 9
North Locust Point Road, Mechanicsburg, Cumberland County,
Pennsylvania.
2. Ian's mother is Carol J. Livingston who resides at 1401
Wellgate Lane, Mechanicsburg, Cumberland County, Pennsylvania.
3. Ian's father is Michael Scott Weidenhammer who resides at
420 Creek Road, Newport, Perry County, Pennsylvania. He consents
to the appointment of Carol J. Livingston.
4. Ian does not have any children.
5. Ian has a half brother, Kyle S. Rossi, born August 30,
1996 who resides with his mother, Carol J. Livingston at 1401
Wellgate Lane, Mechanicsburg, Cumberland County, Pennsylvania..
6. Ian receives Life Sharing services through Susquehanna
Development Services, Diane Kothe, Life Sharing Support
Coordinator, 2001 N. Front Street, Suite 232, Harrisburg, Dauphin
County, Pennsylvania.
7. Ian resides with Rose Kramer, his Life Sharing provider,
at 9 North Locust Point Road, Mechanicsburg, Cumberland County,
Pennsylvania.
8. Ian is not employed, but is enrolled full-time in the
Cumberland Valley school district.
9. Petitioner requests that she be appointed primary
guardian of her son and that Michael S. Weidenhammer be appointed
alternate guardian.
10. Neither Petitioner nor Michael S. Weidenhammer have an
interest adverse to Ian's.
11. Petitioner seeks guardianship since Ian is not able to
handle his own financial or other personal affairs.
12. Ian has resided with Rose Kramer for many years.
13. Petitioner has provided Ian's primary care throughout his
life and continues to have regular meaningful contact with him.
14. Ian has had a multitude of medical problems since birth
including profound mental retardation, cerebral palsy,
hydrocephalus and has been in a persistent nonverbal state.
15. Ian is unable to independently ambulate.
16. Ian does not have cognitive thought process and is
unable to make decisions or respond to inquiries.
17. Ian is not able to dress himself, perform any household
chores or provide his own basic personal hygiene.
18. Petitioner has been Ian's social security representative
payee since entitlement.
19. Ian receives $674.00 each month in Supplemental Security
Income (SSI) .
20. Petitioner maintains a Ian's checking account a Members
1st Federal Credit Union with an average balance of less than
$1,000.00.
21. Ian has funeral plan account with Fore Thought with a
balance of $1,400.00.
21. Petitioner has been responsible for and been paying for
Ian's needs since birth.
22. Ian's primary expense is $485.28 for his housing and
care.
WHEREFORE, it is requested that Carol J. Livingston be
appointed the legal guardian of the person and estate of her son,
Ian Michael Weidenhammer, and that Michael S. Weidenhammer be
designated as her alternate.
