17043, is about to execute contemporaneously herewith, a contract, with East Coast Contracti , In@ of -6
160 Lamont Street, New Cumberland Pennsylvania 17040, for the construction upon a building premises
commonly known as 1007 Rimer Highway, Borough of Carlisle, Cumberland County, Pennsylvania, as set
forth in the deed dated I a ;q, tA at Instrument Number C I 0 `V O y11? in the
Recorder's Office for Cumberla d County, Pennsylvania, as more specifically described in Exhibit "A"
which is incorporated herein and attached hereto.
NOW, Febmary 24, 2010, at the time of and immediately before the execution.. of the principal
contract, and before any authority has been given by the said Owner to the said Contractor to commence
work on the said building, or purchase materials for the same in consideration of the making of the said
contract ,With Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by OtiTwr,
it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by
any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra
labor or materials purchased for the construction of said building, the right to file such liens being
expressly waived.

ALL THAT j FRTAP,4 tract of land situate in the Fourth Ward Annex of the Borough of
Carlisle, Cumberiand County, Pennsylvania, bounded and described in accordance with a
survey done by Brehm-Lebo Engineering, Inc., for a Final Land Development Plan for
Pizza Grille, dated March 2, 2009, and recorded in the Cumberland-County Recorder of
Deeds office as set forth in Instrument Number 200923965, as follows:
BEGINNING at a point in the Ritner Highway (S.R. 0011) at lands now or formerly of
Leonard R. McKee, Jr.; thence, North 25 degrees 37 minutes 29 seconds West crossing
through an existing iron pin at a distance of 28.09 feet from said point a distance of
172.56 feet to an existing iron pin at southern line of right-of-way now or formerly of
Norfolk Southem Railroad Company; thence along said southern line of right-of-way
now or formerly of Norfolk Southern Railroad Company North 85 degrees 17 minutes 42
seconds East a distance of 486.05 feet to a point on the northern side of the Ritner
Highway (S.R 0011); thence in and through the Ritner Highway (S.R. 0011) South 64
degrees 30 minutes 00 seconds West a distance of 454.01 feet to a point, the Place of
BEGINNING.
CONTAINING a total area of 39,171.88 square feet, (0.899 acres), and subject to all
easements and restrictions, visible or of record.
SAID TRACT of land originally created and described as Lot No. I on the Final,
Subdivision Plan for Jimmie C. George, Richard C. Reed, and Robert M. Frey; prepared
by Stephen G. Fisher, dazed May 2, 1990, recorded in Cumberland County Plan Book 61,
