AMILY SETTLEMENT A

KNOW ALL MEN BY THESE PRESENTS, that
WHEREAS, E~ eanor R. Berg, Late of Carlisle, Cumberland County,
Pennsylvania, died testate on February 12, 2008,
WHEREAS, the said Thomas H. Berg, her son, was issued Letters Testamentary
on the estate of the said decedent, which were duly issued by the Register of
Wills of Cumberland County, PA to the said Executor hereinafter called the
personal representative, to No. 2108-00238.
WHEREAS, the said personal representative has gathered the assets of the estate
of the said decedent and the assets consist of cash and real estate and stocks and
bonds for a total value of $3,214,567.64, as set forth below:
Stocks and bonds $2,121,128.07
Cash $ 858,378.66
Jointly Owned Property $ 224,795.87
Annuities $ 10,265.04
$3,214,567.64
WHEREAS, the debts and deductions in the said estate, amount to $319,033.31
And Inheritance taxes of $ 117,916.00
And Federa~ Estate Tax of $ 435,769.00
And Income Taxes for the Estate of $ 10,000.00
And Charitable Bequests of $ 140,000.00
Total Debts and charitable bequests $1,022,718.31
Recapitulation
Total Assets $3,214,567.64
Total Debts $1,022,718.31
Balance for Distribution $2,191,849.33

Therefore, there is a balance for distribution of $2.191,849.33 to be
distributed as follows:
Two bequests were given as follows:
Phillip Berg $10,000.00
Claire Spencer Berg $10,000.00
Total $20,000.00
WHEREAS, It is agreed among the parties to this Release, that Thomas H. Berg
and Richard A. Berg,, the decedent's two sons shall receive the Balance for
Distribution in equal shares as follows:
Thomas H. Berg $1,085,924.66
Richard A. Berg $1,085,924.67
Total Distributed
$2,191, 849.33
WHEREAS, the balance for distribution has been distributed as set forth in the
above schedule of distribution.
NOW, THEREFORE we, the undersigned beneficiaries, being all of the
beneficiaries of the said decedent and being those persons entitled to inherit do
hereby, each of us, acknowledge that we have received from the aforesaid estate,
in full satisfaction any sums of money due us.
AND, each of us does hereby stipulate and agree that in order to avoid the
expense and time involved in the filing of a formal account and schedule of
distribution, that no account is necessary and we do hereby agree and consent to
distribution being made without the filing of an account and schedule of
distribution to be with the same force and effect as if filed and confirmed by the
Orphans' Court Division of the Court of Common Pleas of Cumberland County,
PA.
THEREFORE, each of us does hereby remise, release, quitclaim and forever
discharge the said personal representative, his heirs, executors, and
administrators and assigns, of and from the said estate and from all actions, suits,
payments, accounts, reckonings, claims, and demands whatsoever for or by
reason thereof, or for any other use, matter, cause or thing whatsoever touching
upon the estate of the said decedent.
