BARISKI I, James L. Bariski, of Monroe Township, Cumberland County, Pennsylvania, declare this to be my Last Will and Testament and revoke all Wills and Codicils previously made by me. ITEM I: I direct that all my legally enforceable debts and funeral expenses, including all expenses of my last illness, shall be paid from my residuary estate as soon as practicable after my decease as a part of the expense of the administration of my estate. ITEM II: I bequeath any automobiles or motor vehicles I may own at my death, my personal effects, such household goods if any as may be my individual property and not the property of my wife or owned jointly by me with her, and other tangible personal property of like nature (not including cash or securities), together with any existing insurance thereon, to my wif ~ Janice T. ITEM III: In the event my mother, Esther E. I direct that my said mother shall not be required to give bond as life tenant and shall not be required to keep such property insured except to protect her interests therein and the contents thereof. I further direct that all taxes, assessments and insurance to protect the interest of my estate in such property shall be paid out of my residuary estate. Upon the death of my said mother or at such prior time as she no longer uses such property as a home, whichever shall first occur, I direct that such property shall be administered and distributed as a part of the residue of my estate. ITEM IV: I devise and bequeath the residue of my estate of every nature and wherever situate to my said wife, providing she survives me by thirty (30) days. ITEM V: Should my said wife predecease me or die on or before the thirtieth day following my death, I devise and bequeath the residue of my estate of every nature and wherever situate in equal shares to my stepdaughters, provided that the share of either of them who predeceases me or dies on or before the thirtieth day following my death shall be distributed to her issue, per stirpes, living on the thirty-first day following my death, and in default of any such then living issue, such share shall be added to the share for my other stepdaughter. ITEM VI: I appoint Hershey Trust Company, of Hershey, Pennsylvania, guardian of any property which passes, either under ~~ this Will or otherwise, to a minor and with respect to which I am authorized to appoint a guardian and have not otherwise specifically done so, provided that this appointment of a guardian shall not supersede the right of any fiduciary in its discretion to distribute a share where possible to the minor or to another for the minor's benefit. Such guardian shall have the power to use principal, as well as income, from time to time for the minor's support, health and medical care, and education (including college education), or to make payment for these purposes, without further obligation or responsibility to see to the proper expenditure thereof, directly to the minor or to the minor's parent or to any person taking care of the minor. ITEM VII: If upon the happening of some event during the administration of my estate, my personal representative(s) shall hold some portion of my estate which is not effectively disposed of under the foregoing diapositive provisions, then one-half of such portion shall be distributed to my then living heirs, as then ascertained under the Intestate laws of Pennsylvania then in effect as though I had died at such time a resident of Pennsylvania owning such property, and the remaining one-half of such portion shall be distributed to the then living heirs of my said wife, as then ascertained under the Intestate laws of Pennsylvania then in effect, as though my said wife had died at such time a resident of Pennsylvania owning such property. ITEM VIII: All Federal, State and other death taxes payable because of my death, with respect to the property forming my gross estate for tax purposes, whether passing under this Will or otherwise, including any interest or penalty imposed in connection with such taxes, shall be considered a part of the expense of the administration of my estate and shall be paid out of the principal of my residuary estate without apportionment or right of reimbursement. ~~~ ITEM IX: I appoint my said wife Executrix of this my last Will. Should my said wife fail to qualify or cease to act as Executrix, I appoint my stepdaughter, Kristin Townsend, Executrix of this my last Will. Should my said stepdaughter fail to qualify or cease to act as Executrix, I appoint my other stepdaughter, Megan Townsend, Executrix of this my last Will. Should my said other stepdaughter fail to qualify or cease to act as Executrix, I appoint Hershey Trust Company, of Hershey, Pennsylvania, Executor of this my last Will. ITEM X: I direct that all fiduciaries acting under this Will, whether or not named herein, shall not be required to give bond for the faithful performance of their duties in any jurisdiction.
