HomeMy WebLinkAbout10-1651S IN RE: TAYLOR DILS, a minor IN THE COURT OF COMMON PLEAS DOB: 09/27/94 CUMBERLAND COUNTY, PENNSYLVANIA NO./6-14X/ 2010 CIVIL ACTION PETITION FOR APPROVAL OF SETTLEMENT FOR A MINOR'S CLAIM AND NOW, comes Monica Dils, the parent and natural guardian of Taylor Dils, through her attorneys Saidis, Flower & Lindsay, and represents the following: 1. Monica Dils is the parent and natural guardian of Taylor Dils, born September 27, 1994, presently 15 years old. 2. Taylor Dils was a passenger on a bus operated by Wolf's Bus Lines, Inc. on May 19, 2008. 3. An accident occurred, and Monica Dils pursued a claim for damages for her daughter, Taylor Dils, against Wolf's Bus Lines, Inc. which was insured by Lancer Insurance Company, 734 Alpha Drive, Suite L, Cleveland, Ohio 44143-2125. 4. Taylor Dils' injuries were minor, consisting of bumps and bruises to her legs from which she recovered within a few days, and emotional upset from the accident from which she recovered within a couple of weeks. 5. Petitioner will execute a General Release in favor of Wolf Bus Lines, Inc. and its driver, Phil Wagaman, in the form attached hereto as Exhibit "A", on behalf of her daughter, the minor child, upon the Court's approval of this proposed settlement 6. Petitioner shall undertake to place said funds in a federally insured bank SAIDIS, FLOWER & LINDSAY 26 West High Street Carlisle, PA account for the benefit of her daughter, proof thereof to be filed with the Court within ten (10) days of the issuance of this Order, to be released to her only when she reaches the age of majority, unless the Court otherwise approves, upon cause shown.. 7. The undersigned counsel for Petitioner will be compensated by Lancer Insurance Company the sum of $500 for attorney's fees for preparation and presentation of this Petition, and the Insurance Company will also reimburse Petitioner the filing fee, resulting in a full payment of $3,500 for the benefit of Taylor Dils. 8. Pa. R.C.P. Section 2039 provides that no action to which a minor is a party shall be settled except after Court approval. WHEREFORE, Petitioner requests that the Court approve the settlement set forth above in the amount of $3,500 to Monica Dils, for the benefit of her daughter, Taylor Dils, as her parent and natural guardian, to be deposited in a federally insured bank account, proof thereof to be filed with the Court within ten (10) days of the issuance of this Order, and authorize Petitioner to execute the General Release attached hereto as Exhibit "A".
