NAILOR, : ACTION FOR DECLARATORY JUDGMENT Defendant COMPLAINT AND NOW, comes Plaintiff, ROBERT KNISLEY, by and through his attorneys, Marcello & Kivisto, LLC, and avers the following: 1. Plaintiff, Robert L. Knisley is an adult individual residing at 704 Pine Grove Furnace Road, Aspers, Adams County, Pennsylvania 17304. 2. Defendant, Milton P. Nailor, is an adult individual with a last known address at 4130 Enola Road, Newville, Cumberland County, Pennsylvania 17241. 3. It is believed that Defendant, Milton P. Nailor, may be currently residing at 4126 Enola Road, Newville, Cumberland County, Pennsylvania 17241. 4. On or about August 22, 2006, Plaintiff and Defendant entered into an oral lease- to-own agreement for a 2000 Kenworth Conventional tractor with VIN 1XKADR9X8YJ841412. 5. Under the lease-to-own agreement for the tractor, Defendant Nailor was to make weekly payments of $250.00 until a total of $40,000.00 was paid to Plaintiff Knisley as the purchase price for the tractor. 6. Pursuant to the agreement for the tractor, Plaintiff Knisley transferred title of the tractor to Defendant Nailor on August 22, 2006. (See Title for Kenworth Tractor attached hereto as Exhibit "A"). 6. On or about August 3, 2007, Plaintiff and Defendant entered into an oral lease-to- own agreement for a 1994 Great Dane Reefer trailer with VIN 1 GRAA9624RB 110801. 7. Under the lease-to-own agreement for the trailer, Defendant Nailor was to make weekly payments of $125.00 until a total of $12,000.00 was paid to Plaintiff Knisley as the purchase price for the trailer. Pursuant to the lease-to-own agreement for the trailer, Plaintiff Knisley transferred title of the trailer to Defendant Nailor on August 21, 2007. (See Title for Great Dane Trailer attached hereto as Exhibit "B") 8. Plaintiff Knisley is listed as a lien holder under both titles. (See Title for Kenworth Tractor attached as Exhibit "A" and Title for Great Dane Trailer attached as Exhibit `B„). 9. No other lien holders are listed on the titles for the tractor and trailer. 10. All interested persons have been included as parties in this matter. 11. Under the lease-to-own agreement, Defendant Nailor satisfied all of his monthly payments through December of 2008. 12. As of December 31, 2008, the remaining balance owed by Defendant Nailor on the tractor was $19,961.00 and the remaining balance due on the trailer was $7,220.00. (See Payment Log for the Kenworth Tractor attached as Exhibit "C" and the Payment Log for the Great Dane Trailer attached as Exhibit "D"). 13. On or about December 31, 2008, Defendant Nailor stopped making payments on the tractor and trailer. 14. On or about December of 2008, Defendant Nailor returned possession of the trailer to Plaintiff Knisley. 15. On or about May of 2009, Defendant Nailor returned possession of the tractor to Plaintiff Knisley after failing to make any additional payments since December of 2008. 16. Defendant Nailor has not made additional payments on tractor and trailer since December 31, 2008. 17. Defendant Nailor has defaulted on the terms of the lease-to-own agreement. 18. Pursuant to Defendant Nailor's breach, Plaintiff Knisley is entitled to title and possession of the tractor and trailer. 19. At this time, the tractor and trailer are titled to Defendant Nailor. 20. Plaintiff Knisley has been unsuccessful at contacting Defendant Nailor to have the tractor and trailer title transferred back to Plaintiff. 21. Plaintiff Knisley is seeking a declaratory judgment order against Defendant Nailor for ownership of the tractor and trailer. (See the proposed order attached as Exhibit "E") WHEREFORE, Plaintiff respectfully requests this Honorable Court enter a declaratory judgment order awarding ownership of the 2000 Kenworth Conventional tractor with VIN IXKADR9X8YJ841412 and the 1994 Great Dane Reefer trailer with VIN 1 GRAA9624RB 110801 to Plaintiff.
