HomeMy WebLinkAbout02-12-10Will No. 2107-1162 RELEASE AND WAIVER KNOW ALL PERSONS BY THESE PRESENTS, that I, the undersigned Donna Smith, hereby acknowledge that I have received from David M. Rothert, Executor of the Last Will and Testament of James W. Fry, cash in the sum of Five Thousand 00/100 Dollars ($5,000.00), being the sum distributable to me from the Estate of James W. Fry under the said Last Will and Testament. I HEREBY WAIVE the right to require the filing of an account by the Executor in the Court of Common Pleas of Cumberland County, Pennsylvania, Orphans' Court Division or elsewhere, or any adjudication in any Court, and agree to this amicable settlement and distribution of the above stated balance, which includes any and all interest accruing to the date of distribution. I agree to refund to the Executor any portion of the distribution to which I am not entitled, and to the extent of said distribution, to indemnify him for claims made against him as Executor for all expenses and costs incurred in connection with any such claims, and agree to refund to the Executor any sums of money which represent my proportional shaze of any additional taxes, or other appropriate expenses which aze, or may become, chazges against the Estate. NOW, THEREFORE, in consideration of the distribution of the above stated amount, I do hereby, by these presents, remise, release, quitclaim and forever dischazge David M. Rothert, Executor, his successors and assigns, from any further claim in connection with this Estate. Fry under the said Last Will and Testament. I HEREBY WAIVE the right to require the filing of an account by the Executor in the Court of Common Pleas of Cumberland County, Pennsylvania, Orphans' Court Division or elsewhere, or any adjudication in any Court, and agree to this amicable settlement and distribution of the above stated balance, which includes any and all interest accruing to the date of distribution.
