Mrs. Killinger was deposed in June, 2009. Some of Mr. Killinger's physkians have also been deposed. At
this time, there is no trial date scheduled for Mr. KIINnger's case. As Avandia Is a Mass Tort case, there arc
numerous Avandia lawsuits being handled in Philadelphia County. As a result, I do not antkipate that there
will be a trial in the Killinger matter until sometime in 2011. Obvbusly, if there are any developments prior to
then, I will be sure to advise.
