PETITION TO SET ASIDE NOMINATION PETITION and OBJECTIONS TO
NOMINATING PETITION FILED BY MARGIE STUSKI
AND NOW, this 16th day of March, 2010, comes Karen K. Deklinski, candidate for the
position of Republican Committeewoman by and through her attorneys, Abom & Kutulakis
L.L.P, and request that the Nomination Petition of Marge Stuski be set aside for not having the
requisite amount of signatures by averring the following:
1. On May 18, 2010 the registered Republican votes may elect only one (1) Republican
Committeewoman from Petitioner's local electoral precinct, Wormleysburg Precinct 1.
2. On March 9, 2010, Margie Stuski filed a nomination Petition with the Cumberland
County Bureau of Elections in order to be placed on the Primary Election ballot as a
Republican Committeewoman in Wormleysburg, Precinct 1. See, Petitions attached
hereto as Exhibit A.
3. On March 8, 2010, Karen K. Deklinski timely filed a nomination petition with the
Cumberland County Bureau of Elections in order to be placed on the Primary Election

ballot as a Republican Committeewoman in Wormleysburg, Precinct 1. See. Petitions
attached hereto as Exhibit B.
4. Ms. Stuski's Petition contains eleven (11) signatures.
5. Mrs. Deklinski's Petitions contains fifteen (15) signatures.
6. Both Petitions contain signatures of two of the same individuals.
7. On March 7, 2010, Jennifer Hale signed line nine (9) of Karen K. Deklinski's Petition.
8. On March 7, 2010, Robert Hale signed line ten (10) of Karen K. Deklinski's Petition.
9. On March 9, 2010, Robert Hale signed line ten (10) of Margie Stuski's Petition.
10. On March 9, 2010, Jennifer Hale signed line eleven (11) of Margie Stuski's Petition.
11. 25 P.S. § 2868 governs the manner in which an individual may sign nomination petitions.
12. 25 P.S. § 2868(b) provides in relevant part:
Each Ngrwr of a mmnumhm peffilion shill sign but one such
pefion forewh of fwe to be f ea and shall declare therein that he
is a registered and enrolled member of the party designated in such
petition: [...].
25 P.S. §2868(b). Emphasis added.
13. 25 P.S. §2937 provides in part that,
If a person shall sign any nomination petitions or papers for
a greater number of candidates than he is permitted under the
provisions of this act, if said signatures bear the same date,
they shall, upon objections thereto, not be counted on any
petition or paper and if they bear different dates, they shall be
dotted in the on kr of theirpr*w* of dale, for only so many
persons as there are candidates to be nominated or elected.

14. It is believed and therefore averred that signatures of both Jennifer Hale and Robert Hale
must be stricken from Margie Stuski's petition.
15. 25 P.S. §2872.1 requires a minimum of ten (10) valid signatures be filed in order to
appear on the primary ballot for elected committeewoman. See, 25 P.S. 2872.1(35).
16. It is believed and therefore averred that with the removal of the signatures of Jennifer
Hale and Robert Hale from the Petition of Margie Stuski, her Petition will not contain the
requisite minimum number of signatures required to appear on the ballot for position of
local committeewoman. See generally, In Re Dimarzio, 65 Pa. D&C.2d 477 (Chester
County Court of Common Pleas 1974) and Brady Nomination Petition, 31 Pa. D&C.2d
711 (Fayette County Court of Common Pleas 1963).
17. It is believed and therefore averred that Ms. Stuski's name must be barred from appearing
on the May 18, 2010, primary ballot for the position of Republican Committeewoman in
Wormleysburg, Precinct 1.
WHEREFORE, it is respectfully prayed that the signatures of Jennifer Hale and Robert Hale
be stricken from the Petition of Margie Stuski. It is further prayed that This Honorable Court
will prohibit Margie Stuski's name from appearing on the May 18, 2010, ballot for the position
of Republican Committeewoman in Wormleysburg, Precinct 1.
