Pennsylvania Department of Corrections, files this Limited Reply to this Court's June 22, 2010
Rule to Show Cause for the sole purpose of raising the lack of jurisdiction of the Court of
Common Plus to adjudicate Petitioner's Petition for Review and lack of personal jurisdiction
over Respondent. By filing this Limited Reply, Respondent does not waive his objection to, nor
acquiesce in, the jurisdiction of this Court.
1. Petitioner, James Elliott, is an inmate incarcerated at the State Correctional Institution at
Greene ("SCI-Greene") in Greene County, Pennsylvania.
2. On or about March 22, 2010, Petitioner filed a Petition for Review with this Court. On
that same date, Petitioner also filed an application for leave to proceed in forma pauperis
and a tnotion requesting that the Court effect personal service on the Respondent.
3. On June 24, 2010, this Court issued a Rule to Show Cause directing the Respondent to
respo d within 20 days of service.
This Limited Reply is timely filed in response thereto.
LACK OF SUBJECT MATTER JURISDICTION
4. To the extent that this Court interprets Petitioner's filing as a Petition for Review, this
Court. lacks subject matter jurisdiction over Petitioner's Petition for Review.
5. Petitioner seeks review of the Department of Corrections' determination that two of his
books violated the Department's incoming publications policy and the agency's action in
.confiscating those books. (Petition, p. 2.)
6. To the extent that Petitioner seeks judicial review of a governmental determination, his
action must be filed with the prothonotary of the appropriate appellate court. Pa. R.A.P.
1511; see also 42 Pa. C.S. § 761 (Commonwealth Court has original jurisdiction over any
action against Commonwealth government, including any officer thereof, with the
exception of those sounding primarily in trespass).
7. Thus,!to the extent that Petitioner's pleading is construed as a petition for review seeking
review of an agency action, and is not primarily an action in trespass, subject matter
jurisdiction lies with the Commonwealth Court.
LACK OF PERSONAL JURISDICTION
8. To the extent that this Court construes Petitioner's filing as an action primarily sounding
in trespass, Respondent concedes that subject matter jurisdiction would more properly lie
with this Court. See 42 Pa. C.S. § 761; see also Stackhouse v. Commonwealth, 574 Pa.
558, $32 A.2d 1004 (2003)(actions against Commonwealth agencies which are primarily
actions in trespass are more properly brought in court of common pleas, rather than
Commonwealth Court).
9. Ass ing that this Court construes Petitioner's pleading as primarily an action in
tresp ss, this Court lacks personal jurisdiction over the Respondent because such an
action may only be commenced by complaint or writ of summons. See Pa. R. Civ. P.
1007.1 see also Commonwealth, Dept of Public Welfare v. Livingood, 349 A.2d 816, 22
Pa. CQmmw. 530 (1976)(petition for rule to show cause was not the proper procedure to
initiatle action.)
10. Regardless of how Petitioner's pleading is construed, this Court also lacks personal
jurisdiction over the Respondent because the Petition has not been served.
11. Service of original process in the courts of common pleas maybe effected only by
personal service. See Pa. R. Civ. P. 400.
12. Petitioner has failed to effect such service.
13. Thus, Petitioner's action must be dismissed for lack of personal jurisdiction over the
Respandent.
WHEREFORE, for the foregoing reasons, Respondent respectfully requests that this
Court dismiss the Petition for Review filed in this matter for lack of subject matter jurisdiction
and lack of personal jurisdiction over Respondent.
