3. On 04/09/1999 JEREMY L. AYERS made, executed and delivered a mortgage upon the
premises hereinafter described to PLAINTIFF which mortgage is recorded in the Office

of the Recorder of CUMBERLAND County, in Book No. 1534, Page 469. The mortgage
and assignment(s), if any, are matters of public record and are incorporated herein by
reference in accordance with Pa.R.C.P. 1019(g); which Rule relieves the Plaintiff from its
obligations to attach documents to pleadings if those documents are of public record.
The premises subject to said mortgage is described as attached.
The mortgage is in default because monthly payments of principal and interest upon said
mortgage due 08/01/2009 and each month thereafter are due and unpaid, and by the terms
of said mortgage, upon failure of mortgagor to make such payments after a date specified
by written notice sent to Mortgagor, the entire principal balance and all interest due
thereon are collectible forthwith.

Notice of Intention to Foreclose pursuant to Act 6 of 1974 is not required because the
defendants are not "Residential Mortgage Debtors" as defined by the Act, having failed to
provide Plaintiff notice of its acquisition of title.

8. This action does not come under Act 91 of 1983 because the mortgaged premises is not
owner-occupied.
9. Mortgagor JEREMY L. AYERS died on 9/9/09, and STEPHANIE AYERS and STACI L.
HAIR were appointed Co-Administrators of his estate. Letters of Administration were
granted to them on 10/12/09 by the Register of Wills of Cumberland County, No. 2109-
0953. Decedent's surviving heir at law and next-of-kin are JESSICA AYERS and AVERIE
MARIE AYERS.
10. Plaintiff does not hold the named Defendants, STEPHANIE AYERS, STACI L. HAIR,
JESSICA AYERS, and AVERIE MARIE AYERS, personally liable on this cause of
action. This action is being brought to foreclose the interest of the said Defendants in the
aforesaid real estate only, and the Defendants have been named in accordance with the
requirements of Pa R.C.P. 1144(a)(2) and 20 Pa.C.S.A. § 301(b).

WHEREFORE, Plaintiff demands an in rem judgment against the Defendant(s) in the sum of
$49,546.70, together with interest from 03/15/2010 at the rate of $6.76 per diem to the date of
judgment, and other costs, fees, and charges collectible under the mortgage and for the
foreclosure and sale of the mortgaged property.

Borough of Mount Holly Springs, Cumberland County, Pennsylvania, bounded and described as
follows:
ON the East by lot now or formerly of Eliza Fergtn, on the South by Mountain Street, on the
West by lot now or formerly of Jessie Harry, and on the North by an alley, having a frontage of
40 feet on Mountain Street, and a depth of 180 feet and being the second lot on Mountain Street
from land now or formerly of Mrs. Walter Beall.
BEING improved with a 2 1/2 story dwelling house known as No. 29 Mountain Street.
BEING THE SAME premises which Jeremy L. Ayers, a single man, and Clarence L. Ayers and
Annette B. Ayers, husband and wife, by their deed dated the 9th day of April, 1999 and to be

The undersigned attorney hereby states that I am the attorney for the Plaintiff in this matter, that
Plaintiff is outside the jurisdiction of the Court and/or the verification could not be obtained within the
time allowed for the filing of the pleading, that I am authorized to make this verification pursuant to
Pa.R.C.P. 1024 (c), and that the statements made in the foregoing Civil Action in Mortgage Foreclosure
are based upon information supplied by Plaintiff and are true and correct to the best of my knowledge,
