the transactions that have occurred during his administration of the estate. This account also
indicates the proposed distribution of the estate.

Note to real estate: Ms. Brown was a religious woman and a collector of tangible property. She
was ninety-three years old at the time of her death and consequently physically limited. She
collected tangible personal property, primarily in an effort to give it to needy people.
Her real estate at 890 and 901 Sandbank Road was her residence. It had two structures located
upon it. The first was a very small house right along the road which was dilapidated. The roof
was falling in and vegetation was growing inside. It had not been inhabited for many years. The
second structure was the residence of Ms. Brown. It was a framed structure sitting on a concrete
slab. It had three bedrooms, a kitchen, bathroom and living room. It was literally packed full of
personal property. There was a pathway inside the front door to the kitchen, bathroom and one
bedroom. The other bedrooms were inaccessible as they were packed full of personal property
and the hallway to access those rooms was blocked with personal property. The bedroom in
which Ms. Brown rested was packed full of personal property, and the only available resting
place therein was a chair, which must have been where Ms. Brown slept. Unfortunately, Ms.
Brown died in that chair and was not found for over a week. The bathroom was cluttered, but
accessible and the kitchen had a mere pathway into it. There was a small area to eat and a small
counter space for food preparation; the rest of the kitchen was packed full of various items. The
lot upon which the structures were located was completely overgrown with brush and small
vegetation. A semi trailer was located in Ms. Brown's front yard, which was full of boxes of
clothing. The semi trailer was rented to her from a local storage business.
The purpose of this discussion is to illustrate the challenges in disposing of the real estate. Time
was of the essence to sell the real estate since the power to the house had been disconnected after
Ms. Brown's death and there was a refrigerator full of food. Also, Ms. Brown passed away
inside the residence and showing it to prospective buyers was difficult.
The executor is Reverend John Ile from Chambersburg, who previously ministered to Ms.
Brown. The executor and undersigned counsel pondered the best course of action to dispose of

the real estate. Undersigned counsel sent letters to all of the neighbors, and one or two neighbors
toured the property in order to possibly make an offer. Undersigned counsel is familiar with a
local person who buys real estate to "fix it up" and sell it, and he looked at the property. A local
realtor, William L. Shearer, Jr., reviewed and toured the property for his advice and evaluation.
A person who routinely inquiries about real estate in decedent's estates wrote to undersigned
counsel to express interest.
There were no assets in the estate to hire a person or firm to clean out the property. The executor
and undersigned counsel did not want to incur a large liability to clean out the property not
knowing the ultimate value of the property and when it might sell. Also, there were liabilities in
the estate so the real estate had to bring some proceeds. The decision was made to sell the
property "as is" and the person who routinely contacts decedent's estates regarding real estate
was the ultimate buyer. The sale was for $50,000.00 and it was an arm's length transaction and
it was the only offer received for the property. Other interested parties suggested that they would
not have offered what the ultimate buyer paid.
Ms. Brown had no known family. Substantial time and effort was made by the executor and
undersigned counsel in getting the real estate sold. The real estate was not listed with a broker.

frequent visitor to the Cumberland County Prison to minister to the inmates. The
executor was charged with making gifts. to charity of her estate, and he selected her
church and the Cumberland County Prison Ministry.

Executor under the Will dated May 9, 2002 and executed by Jeannette B. Brown, deceased, has
been filed with the Clerk of the Orphans Court Division of the Court of Common Pleas of
Cumberland County, Pennsylvania, and will be called for audit before the Honorable Judges of
said Court on the 22°d day of April, 2010, at 9:30 a.m. in Courtroom Number 1, of the
Cumberland County Courthouse, Carlisle, Pennsylvania. Your interest in the Estate consists of:

John Ile, Executor of the Estate of Jeannette B. Brown, deceased, hereby declares under
oath that he has fully and faithfully discharged the duties of his office; that the foregoing First
and Final Account is true and correct and fully discloses all significant transactions occurring
during the accounting period; that all known claims against the estate have been paid in full;
that, to his knowledge, there are no claims outstanding against the estate; that all income taxes
presently due from the Estate have been paid, and that all inheritance tax has been paid; and that
the grant of Letters Testamentary and first complete advertisement thereof occurred more than
four months before the filing of the foregoing First and Final Account.
This statement is made subject to the penalties of 18 Pa.C.S.A. section 4904 relating to

LAST WILL AND TESTAMENT

I. Jeannette B. Brown, of Cumberland County, Pennsylvania, being
of sound mind, memory and understanding, do hereby make, publish and declare
this as and for my Last Will-and Testament, hereby revoking all other wills

FIRST
(~~~ I direct the payment of my debts and the expenses of my last

illness and funeral from my estate as soon after my death as conveniently may

!' be done. I have preplanned my funeral and all other arrangements associated

I make the following specific bequests:
A. My collection of Native American items shall be given to
Susquehanna University to be disposed of by those persons associated with a
trust created to assist Native Americans.
B. All my jewelry, furs, sterling silver and china to Anna Mae Ile.
C. My bible collection and books to Reverend John Ile. If possible,
I would like him to display the bible collection during World Bible Week.
D. My electric player piano with rolls and the Wurlitzer electric
~~ organ with speaker, to the Reverend John and Anna Mae Ile.

of my estate of whatever nature or wherever situate to Reverend John Ile and
Robert L. O'Brien. Esquire, or the survivor, in trust, for them to distribute
to the local charitable organizations that I have been associated with. Their
decision shall be final and in their discretion they may give to one, a few,
or many of the organizations, in such amounts as they determine. In the event
that they reach an impasse on-a distribution, the Court shall appoint a local
minister to provide binding arbitration.
FOURTH
I direct that no trustee, personal representative, guardian or
other fiduciary named, nominated, or appointed by this my Last Will and
Testament shall be required to post any bond or give any security of any type
for any purpose whatsoever, any law or rule of the court of the Commonwealth
of Pennsylvania or any other jurisdiction to the contrary notwithstanding.
FIFTH
My personal representative shall have the following powers in
addition to those vested in them by law and by other provisions of this will,
applicable to all property, real, personal or mixed and wheresoever situate,
including property held for minors, whether principal or income, exercisable
without court approval, and effective, with respect to each item of said
