STIPULATION AGAINST LIENS
WHEREAS, BRADLEY D. FERGUSON AND CHRISTINA M. FERGUSON, (the"Owners"), have
executed or are about to execute simultaneously herewith a contract with JASON TIDAY, (the
"Contractor"), for construction work (collectively the "Improvements") on a parcel of land
known as LOT 21:110 Balfour Drive, situate in the TOWNSHIP OF SILVER SPRING, County of
CUMBERLAND, Commonwealth of Pennsylvania, known as Tax Parcel No. 38-07-0457-041, and
more particularly described in Exhibit A attached hereto, incorporated herein by reference and
made a part hereof (the "Premises").
NOW, MARCH 26, 2010, before any authority has been given by the Owner to the
Contractor to commence work on the Improvements, or to purchase materials for the same, or
to enter into any contracts with any subcontractors or material men, or to authorize any
purchases by or through any subcontractors or material men, in consideration of the making of
said contract with the Owner and the further consideration of One ($1.00) Dollar, to Contractor
paid by Owner, and with the intent of all parties to be legally bound hereby, it is agreed that no
lien shall be filed against the Improvements, the Premises, or any part thereof, by the
Contractor or any subcontractor, or by any of the material men or workmen or any other
person for any labor, or materials purchased, or extra labor or materials purchased, for the
improvements to the Premises (including hereafter changes made thereto), the right to file
liens being expressly waived.
It is the full intent of the Contractor, for himself and for any subcontractors or material
men claiming for themselves, or by, through or under the contract or the Contractor, that the
right to file a mechanic's lien, under the provisions of law and/or of Acts of Assembly in such
cases made and provided, for work done or materials furnished in ad about the construction of
the Improvements to the Premises is hereby waived.

PROPERTY DESCRIPTION
The land referred to in this Commitment is described as follows:
EXHIBIT A -110 Balfour Drive
ALL THAT CERTAIN tract or parcel of land being situated in Silver Spring Township, Cumberland County,
Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a point located on the western right-of-way line of Balfour Drive (50-foot right-of-way) at the
southern corner of Lot 20 on the hereinafter referenced Plan; thence along the southern boundary line of Lot 20,
South 76 degrees 13 minutes 56 seconds West, a distance of 222.75 feet to a point of other lands of Grantor;
thence South 15 degrees 08 minutes 12 seconds East, a distance of 100.39 feet to a point at the northwest
corner of Lot 22 on the hereinafter referenced Plan; thence along the northern line of Lot 22, North 76 degrees
03 minutes 32 seconds East, a distance of 27.81 feet to a point on Balfour Drive; thence along the western
right-of-way line of Balfour Drive, North 15 degrees 08 minutes 12 seconds East, a distance of 5.74 feet to a
point; thence continuing along same by a curve to the left having a radius of 875.00 feet and an arc length of
94.27 feet to a point, the point and place of BEGINNING.
BEING Lot No. 21 on the Final Subdivision Plan of Millfording Highlands, Phase I, recorded March 6, 2007, in the
Cumberland County Recorder of Deeds Office in Plan Book 93, Page 129.
BEING KNOWN as 110 Balfour Drive, Mechanicsburg, Pennsylvania 17050.
