IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA NUMBER TERM, 2004 MARK L. WENGER and KELLEY L. RUSENKO, OWNER, adult individuals with a residence address of 2 Meadowview Court, Mechanicsburg, Pennsylvania, hereinafter called "Owner", have entered into a contract with SEALOVER HOMES, INC., CONTRACTOR, a Pennsylvania corporation with its principal place of business at 211 Cherokee Drive, Mechanicsburg, Pennsylvania, hereinafter called "Contractor", for the erection of a single family residential dwelling upon land of Owner situate in Silver Spring Township, Cumberland County, Pennsylvania, being more particularly bounded and described on Exhibit "A," attached hereto and made part hereof. NOW, this ~> ~day of June, 2004, before any authority has been given by the said Owner to the said Contractor to commence work on the said improvements or purchase materials for the same, in consideration of the making of the said contract with Owner and the further consideration of One Dollar ($1.00), to Contractor paid by Owner, it is agreed that no lien shall be filed against said property by the Contractor, or any sub-contractor, nor by any of the material-men or workmen or any other person for any labor, or materials pumhased, or extra labor or materials pumhased for the installation and construction of said municipal improvements, the right to file such liens being expressly waived. By: ~~"~ (SEAL) Name: Title: :230236 EXHIBIT "A" ALL that certain lot of unimproved land situated in the Township of Silver Spring, County of Cumberland and Commonwealth of Pennsylvania, more particularly bounded and described as follows: BEGINNING at a monument on the western dedicated right-of-way line of Keystone Drive at the dividing line between Lot No.1 and commercial Lots Nos. 8 and 9, as shown on the hereinafter mentioned plan of lots; THENCE along said dividing line between Lot No. 1 and Lot Nos. 8 and 9 North 87 degrees 14 minutes West a distance of 551.65 feet to the dividing line between Lots Nos. 1 and 31 as shown on said lots; THENCE along said dividing line between Lots Nos. 1 and 31, North 23 degrees 47 minutes 35 seconds East, a distance of 299.76 feet to a point at a corner common to Lots Nos. 1, 31, 24, and 25 as shown on said plan of lots; THENCE along the line dividing Lot No. 1 from Lots Nos. 25 and 26, North 63 degrees 28 minutes East, a distance of 358.64 feet to a point at the dividing line between Lots Nos. 1 and 10 as shown on said plan; THENCE along said dividing line between Lots Nos. 1 and 10, the following two (2) courses and distances: la) South 39 degrees 41 minutes 12 seconds East, a distance of 256.17 feet to a point; and (b) South 87 degrees 14 minutes East, a distance of 200 feet to the western dedicated right-of-way line of Keystone Drive; THENCE along said western dedicated right-of-way line of Keystone Drive, South 2 degrees 46 minutes West, a distance of 254.63 feet to a monument on the same, the place of BEGINNING. BEING Lot No, I as shown on a certain plan of lots entitled "Final Subdivision Plan of Enchanted Hills" as recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 76, Page 37. BEING THE SAME PREMISES WHICH Greater Keystone Properties, Inc., a Pennsylvania business corporation, by Deed dated May 3, 2004 and recorded May 14, 2004 in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania in Deed Book 263, Page 36, granted and conveyed unto Mark L. Wenger and Kelley L. Rusenko, Mortgagors herein.
