AND NOW, this ~ ~ y of / /2010, this matter having been called for
a hearing, the Court finds, upon clear and convincing evidence, that Sybil Arms is an
incapacitated person in that she suffers from a mental impairment that prevents her from
receiving and evaluating information effectively and prevents her from formulating and
communicating decisions to such a significant extent that she is unable to manage her
financial affairs or meet essential requirements for her physical health and safety on a
daily basis.
The Court appoints Cumberland County Aging and Community Services, in and
for Cumberland County, Pennsylvania, as Permanent Plenary Guardians of the Person
and Estate of Sybil Arms.
Cumberland County Aging & Community Services is also authorized to obtain
payment for its services pursuant to the Fee Schedule attached to its Petition; and
Cumberland County Aging & Community Services is further authorized to obtain
payment of a Guardian fee subject to a maximum of 10% of Sybil Anns's gross monthly
income or $100.00 per month, whichever is less, pursuant to Medical Assistance
Regulations, at such time that Sybil Arms no longer has sufficient assets to pay for
Guardianship services and would qualify for Medical Assistance.
