and respectfully states as follows:
1. For the reasons set forth in the below numbered paragraphs, no counsel
has been retained on behalf of Garnet J. Hackling, the alleged incapacitated person, and
it is suggested that it would be inappropriate and unnecessary for counsel to be appointed
to represent the said of Garnet J. Hackling.
2. The alleged incapacitated person's physician, Michael O. Daniels, M.D..
testified at his deposition that the alleged incapacitated person would be incapable of
communicating with counsel because she would be unable to understand any discussions
with counsel. (N. T., 5-6)
3. Her physician further testified that the Petitioner has always acted in the
alleged incapacitated person's best interests and has been faithfully involved in her care.
