Respondent is Joshua Luke Laughman, an adult individual whose current address or whereabouts are unknown. 3. The parties are the natural parents of one minor child, namely, Layla London Laughman, born on January 18, 2007, in Dauphin County, Pennsylvania. A copy of her birth certificate is attached hereto and incorporated herein by reference as Exhibit "A". 4. The parties were not married at the time of her birth or one year prior. 5. The parties are subject to an Order of Court, dated June 10, 2008, ?I 26 West Higl Street Carlisle, A relative to custody of the child, which provides that Petitioner shall exercise sole legal and primary physical custody; Respondent shall exercise visitation only when he files the appropriate petition requesting it. A copy of the Order of Court is attached hereto and incorporated herein by reference as Exhibit 6. Respondent did not appear at the conciliation conference for entry of the custody Order, and Respondent has not made contact with Petitioner since the entry of the Order to request visitation with the child. 7. Petitioner has received no financial support whatsoever from Respondent since the parties' separation in May 2008. 8. Since the entry of the Order of Court for custody, Petitioner and the minor child have continued to reside at their current address in Mechanicsburg, where they have resided since separation from Respondent. 9. Petitioner provides sole financial and emotional support for the child. 10. Petitioner provides for the child on a day to day basis without any assistance, input or contribution from Respondent. 11. Petitioner resides with her grandparents and has a family support system in the Cumberland County area. 13. Petitioner has not been contacted by any family on behalf of Respondent since separation from Respondent in May 2008 with regard to the child. 14. Petitioner maintains her maiden name and desires that her child maintain her family maiden name as well for consistency. 15. The child has started daycare, and will be starting school in the Fall of 2013 and Petitioner is requesting the name change prior to that time. 16. Petitioner desires for this matter to be made clear and for Petitioner's legal name to be changed to "Layla London Switzer" for all intents and purposes. 17. Respondent has an extensive criminal background, with case histories from Cumberland, Dauphin and York counties, for arrests related to various drug charges, conspiracy, retail theft and providing false identification. A copy of Respondent's criminal court summary is attached hereto and incorporated as Exhibit T." 18. Respondent's last known address was a townhouse in Etters, York County, Pennsylvania, where the parties' resided jointly. 19. Although Respondent has a criminal background and an open case with Cumberland County, contact with probation has not yielded a current address. A copy of correspondence to Cumberland County Probation Department is attached hereto as Exhibit T." 20. A search for Respondent's address in the phone book, WhitePages.com - Online Directory Assistance, and Google, have produced no good address for him. Woloshin, Conciliator. The matter is before the Court on Mother's Complaint for Custody seeking primary physical custody. Mother appeared with counsel. Sole legal custody means the right of a party to exercise parental control over and make major decisions for the benefit of the child, including, but not limited to, educational, medical and religious decisions, without the necessity of obtaining the agreement of any other party. Notwithstanding that Mother has sole legal custody, Father shall have access to the child's medical, dental, religious and educational records pursuant to 23 Pa. C_S_ §5309(a). If Father has any questions concerning the child's well being, he should direct those questions to Maternal Grandmother, Lindy Switzer. PHYSICAL CUSTODY Since Father failed to appear at the Conciliation Conference, we decline to award him any rights of physical custody at this time. If Father wishes to seek rights of visitation or physical custody, he shall file the appropriate petition requesting the same. In the meantime, primary physical custody of the Child, as that term is defined in the Custody Act, shall be with Mother. The parents are encouraged to attempt to resolve any request by Father for visitation or partial physical custody by agreement. However, any such discussions should occur between Father and a third party at least during the pendency of the PFA Order.
