I, CLAIRE L. GIBBONS, of Camp Hill, Cumberland County,
Pennsylvania, do hereby make my last will and testament, revoking
all testamentary dispositions heretofore made by me.
1. I give, devise and bequeath all my estate, real and
personal and wheresoever situate, to my husband, Miles J. Gibbons,
if he survives me.
2. If my said husband predeceases me, I dis~jose ef all
my estate as fellows:
(a) I give to the Camp Curtin Trust Company, Harris-
burg, Pennsylvania, the sum of Two Thousand ($2,000.00) D~ilars to
invest and reinvest and to hold and accumulate the income therefrom
and to use the entire fund for the benefit of my mother-in-law, Margaret
A. Gibbons, of Scranton, Pennsylvania, during her lifetime. I direct
my said Trustee to pay from the said funds the premiums on life in-
surance policy carried on the life of my said mother-in-law with the
Women' s Benefit Association, Port Huron, Michigan, the premiums thereon
now being paid to Mrs. Irene Kelly, 3 Owen Street, Pittston, Pennsyl-
vania. I further direct my said Trustee to pay te my mother-in-law the
sum of Forty ($40.00) Dollars per month from the said fund for and dur-
ing her natural life. I further authorize my Trustee at a~ny time or
from time to time to use any part or all of the said funds held by it
to pay any medical expenses or to meet any other emergency pertaining
to my said mother-in-law. Any balance remaining in the said fund at
the time of my mother-in-law's death shall revert to my residuary estate.
(b) My mother-in-law, Margaret A. Gibbons, shall
have the right to occupy premises known and numbered 1931-33 Lafayette
Street, Scranton, Pennsylvania, and to permit others to occupy the same
with her. If at any time my said mother-in-law is unable or unwilling
to continue to occupy the said premises, the rights given to her under
this paragraph shall cease.
(c) I give to my mother, Lydia G. Kennedy, Scranton,
Pennsylvania, the sum of One Thousand ($1,000.00) Dollar~ if she survives
(d) All the rest, residue and remainder of my estate,
real, personal and wheresoever situate, I give, devise and bequeath, in
equal shares, to my children. If any child shall predecease me leaving
issue surviving him, the said issue shall take the share which the de-
ceased child would have taken if she or he had survived me.
3. I direct that all estate, inheritance and succession
taxes, interest and penalties on property passing under this my will,
or any codicil thereto, shall be paid out of the principal of my general
estate to the same effect as if such taxes were expenses of administration,
and all legacies, devises and other gifts of principal and income made by
this my will, or by any codicil thereto, shall be free and clear thereof.
In the absolute discretion of my Executor or Trustee, such taxes may be
paid immediately, or payment may be postponed on future or remainder
interests until possession thereof accrues to the beneficiary.
4. I nominate, constitute and appoint my husband, Miles J.
Gibbons, to be the Executor of this my will. If at any time my said
husband is unable or unwilling to so act, I appoint my son, Miles J.
Gibbons, Jr. to be my Executor.

home was dated but in good to average condition. Condition adjustment reflects subject's need for floor coverings
and painting. Home on corner lot with walk-out basement which is appealing in this market place. features
included: hardwood floors, large fireplace, and rear porch. Sale #3 located to rear of subject. Home in good
condition. Features included: large kitchen with newer appliances, counter tops and sink; small fireplace in dining
room; newer furnace and roof; some replacement windows; oversized garage, and whole house fan. All sales
considered equally with most weight placed on Sale #2 and #3 which are located closest to the subject.
Consideration given to subject's condition and damp basement. Based on market sales, the subiect would sell in
the range of $150,000 to $155,000.
Estimated indicated value Can also be determined by using the Gross Adjustment of sale price for each
comparable (comp) as a meaSure of relative quality of the compo A lower adjustment indicates a beller comp, and
vice versa. The ratio of gross dollar adjustment to sale price for each of the camps is used to calculate the weight
each comp should have in a weighted calculation. This weighted calculation is used to also indicate the estimated
value of the subject. As with any method this technique is not perfect. However it does do a very good job of
giving more weight to the most similar comps while at the same time minimizing values near the extremes of the
indicated value range. The estimated weighted value is: $152,900 which supports the estimated value.

I, CLAIRE L. GIBBONS, of Camp Hill, Cumberland County,
Pennsylvania, do hereby make my last will and testament, revoking
all testamentary dispositions heretofore made by me.
1. I give, devise and bequeath all my estate, real and
personal and wheresoever situate, to my husband, Miles J. Gibbons,
if he survives me.
2. If my said husband predeceases me, I dispose of all
my estate as follows:
(a) I give to the Camp Curtin Trust Company, Harris-
burg, Pennsylvania, the sum of Two Thousand ($2,000.00) Dollars to
invest and reinvest and to hold and accumulate the income therefrom
and to use the entire fund for the benefit of my mother-in-law, Margaret
A. Gibbons, of Scranton, Pennsylvania, during her lifetime. I direct
my said Trustee to pay from the said funds the premiums on life in-
surance policy carried on the life of my said mother-in-law with the
Women's Benefit Association, Port Huron, Michigan, the premiums thereon
now being paid to Mrs. Irene Kelly, 3 Owen street, Pittston, Pennsyl-
vania. I further direct my said Trustee to pay to my mother-in-law the
sum of Forty ($40.00) Dollars per month from the said fund for and dur-
ing her natural life. I further authorize my Trustee at any time or
from time to time to use any part or all of the said funds held by it
to pay any medical expenses or to meet any other emergency pertaining
to my said mother-in-law. Any balanoe remaining in the said fund at
the time of my mother-in-law's death shall revert to my residuary estate.
(b) My mother-in-law, Margaret A. Gibbons, shall
have the right to occupy premises known and numbered 1931-33 Lafayette
street, Scranton, Pennsylvania, and to permit others to occupy the same
with her. If at any time my said mother-in-law is unable or unwilling
to continue to occupy the said premises, the rights given to her under
this paragraph shall cease.
(c) I give to my mother, Lydia G. Kennedy, Scranton,
Pennsylvania, the sum of One Thousand ($1,000.00) Dollar~ if she survives
me.
(d) All the rest, residue and remainder of my estate,
real, personal and wheresoever situate, I give, devise and bequeath, in
equal shares, to my children. If any child shall predecease me leaving
issue surviving him, the said issue shall take the share which the de-
ceased child would have taken if she or he had survived me.
3. I direct that all estate, inheritance and succession
taxes, interest and penalties on property passing under this my will,
or any codicil thereto, shall be paid out of the principal of my general
estate to the same effect as if such taxes were expenses of administration,
and all legacies, devises and other gifts of principal and income made by
this my will, or by any codicil thereto, shall be free and clear thereof.
In the absolute discretion of my Executor or Trustee, such taxes may be
paid immediately, or payment may be postponed on future or remainder
interests until possession thereof accrues to the beneficiary.
4. I nominate, constitute and appoint my husband, Mi~es J.
Gibbons, to be the Executor of this my will. If at any time my said
husband is unable or unwilling to so act, I appoint my son, Miles J.
Gibbons, Jr. to be my Executor.

The circumstances leading up to the execution of this instrument are as follows; -,

1. Claire L. Gibbons died on May 31, 2004, leaving a Will dated February 10,
1960, naming Miles J. Gibbons, Jr. as Executor.
2. Letters Testamentary were granted to Miles J. Gibbons, Jr. by the Register of
Wills of Cumberland County on June 14, 2004.
3. It is the desire of the Claire L. Gibbons heirs that the Estate be distributed
without the formality of a court proceeding in order to save the expense, publicity, and delay
incident to such court proceeding, and the Executor is willing to make such distribution upon
the execution of this instrument.
4. An account of the administration of the Estate of Claire L. Gibbons has been
prepared by the Executor. A copy is attached hereto as Exhibit A.
5. In consideration of the foregoing, each of the undersigned hereby:
A. Represents and warrants that he/she has read and understands this
instrument and that the facts set forth above are true and correct to the best of his/her
knowledge, information and belief;
B. Declares that he/she has examined the attached account of the administration

of the Estate and the attached schedule of distribution; that he/she finds them to be true and
correct in all particulars; that he/she accepts and approves them as if they had been duly filed,
audited, adjudicated and confirmed absolutely by the Orphans' Court Division of the Court of
Common Pleas of Cumberland County, and as if the amounts shown as distributable had been
duly awarded to him/her;
C. Waives the filing and auditing of the account of the administration of the
Estate in the Orphans' Court Division of the Court of Common Pleas of Cumberland County,
and agrees that the Orphans' Court Division of the Court of Common Pleas of Cumberland
County may by its decree confirm the account and approve the schedule of distribution;
D. Requests the Executor to make distribution of the principal and income in
accordance with the schedule of distribution, and effective upon delivery to him/her of the
amounts shown as respectively distributable, acknowledges receipt of such property;
E. Agrees to refund to the Executor any amount which may at any time be
determined to have been an erroneous distribution to him/her, regardless of the cause of such
erroneous distribution, even if attributable to negligence, and agrees that any period for the
limitation of actions for the collection of any erroneous distribution shall commence only at
such time as the Executor shall have obtained actual knowledge of such erroneous distribution
and that in no event shall the period for collection of any erroneous distribution be less than
two years after the actual discovery thereof;
F. Absolutely and irrevocably remises, releases, quitclaims and forever
discharges Miles J. Gibbons, Jr., individually and in his capacity as Executor, from any and all
actions, suits, payments, accounts, reckonings, liabilities, claims and demands relating in any

way to the administration of the Claire L. Gibbons Estate;
G. Agrees to indemnify and hold harmless, to the extent of the funds received
by him/her hereunder, Miles J. Gibbons, Jr., individually and in his capacity as Executor,
from and against any and all claims, loss, liability or damage (including legal fees and costs in
connection therewith) which he/she may suffer or to which he/she may be subjected by reason
of his administration of the Estate, the settlement of his Executor's account and the distribution
of the assets af the Estate without having the formal approval of the Orphans' Court Division
of the Court of Common Pleas of Cumberland County, including, but not limited to, any
liability for any federal estate tax, Pennsylvania inheritance tax or any other death taxes,
together with interest and costs incidental thereto, relating in any way to the Estate; and
H. Declares it to be his/her intention that this instrument, consisting of three
pages, shall be governed by the law of Pennsylvania and shall be legally binding as an
agreement under seal upon him/her and upon his/her heirs, executors, administrators and
assIgns.
