HomeMy WebLinkAbout04-2648JUDGMENT NOTE $ 42,480.00 September 19 ,2003 FOR VALUE RECEIVED, STEPHEN CHARLES CURR3~N and PAMELA ANN CURRAN, husband and wife, hereby promises to pay to the order of SAMUEL B. BITNER, the principal sum of Forty-two Thousand Four Hundred Eighty and NO/100 ($42, 480.00} Dollars, plus interest at the rate of 5.99% per annum, payable in monthly installments of Six Hundred Eleven ($611.00) Dollars until said principal and interest are fully paid. THE SAID PAYMENTS shall be made in accordance with a note and home equity mortgage given by Samuel B. Either to Members 1~t Federal Credit Union. SHOULD the undersigned fail to make any installment as aforesaid, the entire amount shall be immediately due and payable together with interest at the legal rate. Further, the undersigned does hereby authorize and empower the Prothonotary or any attorney of any county of record in Pennsylvania or elsewhere to appear for or enter ~udgment against the undersigned for the above sum with or without declaration, with costs of suit, release of errors, without stay of execution, and with 15% added for collection fees; the undersigned hereby agrees not to make the any motion or any application whatsoever in any court for inquisition on any real estate that may be levied upon to collect the aforesaid sum and the undersigned voluntarily condemns same and authorizes the Prothonotary to enter said voluntary condemnation upon the writ of execution against the undersigned and further agrees that any property real, personal, or mixed may be sold through a writ of execution and further hereby waives and releases all relief from any and all appraisements stay or exemption laws of any state now enforce or which are passed hereafter.
