PETITION FOR REVIEW OF ORDER OF
DEPARTMENT OF TRANSPORTATION
SUSPENDING OPERATING PRIVILEGE
TO THE COURT OF COMMON PLEAS OF DAUPHIN COUNTY
Petitioner, Frank.A. Richardson, Jr., by the undersigned counsel respectfully
petitions the Court pursuant to 75 Pa. C.S.A. Section 1550 for review of an order of the
Department of Transportation suspending petitioner's operating privilege, and in support
thereof represents as follows:
1. Petitioner, Frank A. Richardson, Jr., is an adult individual residing at 9
William Penn Drive, Camp Hill, Cumberland County, Pennsylvania
17011.
2. Petitioner currently possesses a valid Pennsylvania driver's license. His
driver's license number is 17758533
3. By letter dated March 24, 2010, petitioner was notified in writing by the
Department of Transportation of the entry of an order suspending his
driver's license for a conviction of Section 1543A of the Vehicle Code. A
copy of the notice is attached hereto as Exhibit A.

4. The suspension notice requires the petitioner to serve a one year
suspension commencing March 24, 2010.
5. The license suspension arises from defendant's conviction of driving under
suspension on March 16, 2010, before District Justice Scott J. Gross. A
true and correct copy of the disposition record is attached hereto and
marked Exhibit B.
6. The date of petitioner's offense was alleged to have been March 3, 2007.
7. Defendant's conviction contravenes 42 Pa. C.S.A. 5553(e) of the Judicial
Code which prohibits any proceedings or action on a summary offense
under the Vehicle Code more than two years after the commission of the
offense.
Petitioner has filed a timely appeal from the summary conviction set forth
in paragraph 5 in the Court of Common Pleas of York County. A hearing
on the appeal has not yet been scheduled. A true and correct copy of the
Notice of Appeal is attached hereto and marked Exhibit C.
WHEREFORE, petitioner respectfully requests that the court set this matter down
for de novo hearing pursuant to 75 Pa. C.S.A. Section 1550 and that the order of the
Department of Transportation be set aside.

This is an Official Notice of the Suspension of your Driving
Privilege as authorized by Section 1543 of the Pennsylvania
Vehicle Code. As a result of your 03/16/2010 conviction of
violating Section 1543A of the Vehicle Code DRIVING WHILE
SUSP/REVOKE on 03/03/2007:
¦ Your driving privilege is SUSPENDED for a period of 1
YEAR(S) effective 03/24/2010 at 12:01 a.m.
This suspension is in addition to any other suspensions al-
ready on your record.
PROVIDING PROOF OF INSURANCE
Within the last 30 days of your suspension/revocation, we
will send you a letter asking that you provide proof of in-
surance at that time. This letter will list acceptable
documents and what will be needed if you do not own a vehicle
registered in Pennsylvania.
IMPORTANT: Please make sure that PennDOT is notified if you
move from your current address. You may notify PennDOT of
your address change by calling any of the phone numbers
listed at the end of this letter.

APPEAL
You have the right to appeal this action to the Court of
Common Pleas (Civil Division) within 30 days of the mail
date, MARCH 24, 2010, of this letter. If you file an appeal
in the County Court, the Court will give you a time-stamped

be valid, you must send this time-stamped certified copy.of
the appeal by certified mail to:
