Davidson, by and through his undersigned counsel, and in support of this Complaint, avers as follows: 1. Plaintiff is John W. Davidson, a sui juris adult residing at 6 W. Dykeman Road, Shippensburg, Cumberland County, PA 17257. 2. Defendant is Shaffer Builders Inc., a Pennsylvania corporation with a corporate mailing address of 401 East Elm St., Suite 150, Conshohocken, PA 19428. 3. On or about October 25, 2007, Shaffer contracted Davidson to perform various plumbing, heating, cooling and related work at the Shippensburg - Apex Village, a property owned by Shaffer. A copy of said contract is incorporated herein and attached hereto. 4. Davidson's work: for Shaffer included a one year warranty on all labor, materials and workmanship. 5. Davidson performed all work called for under terms of the October 25, 2007 contract with Shaffer. 6. In spite of repeated demands for payment, Shaffer has failed to pay $43,361.80 to Davidson. COUNT I - BREACH OF CONTRACT 7. Paragraphs 1-6 above are restated herein, as set forth above. 8. Davidson has performed all terms and conditions of the contract in this matter. 9. Shaffer's failure to pay Davidson for the contracted services amounts to a breach of contract. WHEREFORE, the Plaintiff respectfully requests that the Court enter judgment in his favor and Defendants for: A. $43,361.80, plus interest, court costs, and attorney fees. B. This allegation refers to a written document which speaks for itself. Notwithstanding, it is admitted that Defendant did contract with Davidson to perform services. 4. Admitted. By way of further response, Davidson did not live up to its one year warranty in that there are numerous failures of the plumbing system installed by Davidson which to this day requires constant repairs because of Davidson's faulty workmanship. 5. Denied. It is specifically denied that Davidson performed all the work called for under the October 25, 2007 contract with Shaffer. To the contrary, the work was not done in a good and workmanlike manner as there are numerous leaks. t 6. Admitted. By way of further response, it is admitted that Defendant has made numerous demands. It is denied that said demands aze warranted because of the numerous leaks and problems that Shaffer had with Davidson's work. I. BREACH OF CONTRACT 7. Denied. No response required. 8. Denied. For the reasons set forth above, Davidson has failed to perform the work as set forth in the contract in a good and workmanlike manner. To the contrary, numerous leaks have occurred in a number of the units of the student housing project due to the faulty and poor workmanship of Davidson. At this point, the extent of the faulty workmanship is not known as not all of the units have been resided in. 9. Denied. This allegation is a conclusion of law which requires no response. WHEREFORE, Defendant requests this Honorable Court to enter judgment in its favor and against Plaintiff. NEW MATTER 10. Defendant incorporates the answers in pazagraphs 1 through 9 above as if set forth at length herein. 11. Because of the poor workmanship as set forth above, Defendant is entitled to a setoff of its damages against any amounts alleged by Plaintiff because of the poor workmanship of Plaintiff.
