Civil Term CIVIL ACTION - LAW JURY TRIAL DEMANDED AND NOW, comes Plaintiff, Erie Insurance Exchange, by and through its attorneys, Johnson, Duffie, Stewart & Weidner, P.C., who files this Complaint by respectfully stating the following: 1. The Plaintiff, Erie Insurance Exchange, (hereinafter Erie) is a Pennsylvania insurance company with a principal place of business located at Rossmoyne Business Center, 4901 Louise Drive, P.O. Box 2013, Mechanicsburg, Pennsylvania 17055. 2. The Defendant, Harleysville Insurance Company of New Jersey (hereinafter Harleysville), is an insurance company with a principal place of business located at 112 West Park Drive, Mt. Laurel, New Jersey 08054. 3. At all times relevant hereto, Plaintiff Erie was the insurer of Dorothy Voydik's vehicle. Counsel for Defendant IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA 1 4. To the extent that Plaintiff Erie has paid certain sums of money to Dorothy Voydik pursuant to an insurance policy, Erie is a subrogee of Dorothy Voydik with respect to the claims made against Harleysville. 5. On or about December 31, 2007, Dorothy Voydik's vehicle was damaged when Defendant's insured, Linda Gallante, backed into her vehicle. 6. At all times material hereto, Defendant was the insurer of Linda Gallante. 7. By reason of the aforesaid property damage sustained, Plaintiff Erie, by reason of a policy of insurance maintained by Voydik, was forced to pay for the property damage sustained, and therefore presented a claim for subrogation. 8. At all times material hereto, Erie and Harleysville were members of the Arbitration Forums, Inc. 9. Pursuant to the agreement, Erie presented a claim request to Harleysville. 10. On or about September 30, 2008, an arbitration hearing was held and Plaintiff was awarded $13,776.80 as a result of the arbitrary decision. A copy of the arbitration award is attached hereto and incorporated herein by reference as Exhibit A. 11. In compliance with Section Five, Rule 5-1 of the Property Subrogation Arbitration Rules, all awards shall be paid within thirty (30) days of publication. A copy of Section Five is attached hereto and incorporated herein by reference as Exhibit B. 12. In compliance with Section Five, Rule 5-2 of the Property Subrogation Arbitration Rules, Plaintiff and Arbitration Forums, Inc. notified Defendant in writing that payment has not yet been made. A copy of Arbitration Forums' December 30, 2009 letter to Harleysville is attached hereto and incorporated herein by reference as Exhibit C. 2 13. Defendant refuses and continues to refuse to make payment awarded to Plaintiff in the amount of $13,776.80. This refusal is in violation of the Arbitration Agreement and done in bad faith. 14. Plaintiff has been forced to incur attorneys' fees and costs pursuant to the agreement and Plaintiff is entitled to recover those fees and costs. 15. Plaintiff avers that damages do not exceed the applicable limits of arbitration referral by Local Rule. WHEREFORE, Plaintiff Erie Insurance Exchange demands judgment against the Defendant Harleysville Insurance Company of New Jersey in the amount of Thirteen Thousand Seven Hundred Seventy-six and 80/100 Dollars ($13,776.80), together with attorneys' fees, interest, and costs of suit. A SECTION FIVE Awards 5-1 The parties shall honor all awards within thirty (30) days of the decision publication date. 5-2 When a party(ies) does not honor the award within thirty (30) days after publication (a) The prevailing company's local representative must immediately send a written request for payment to the adverse company's local senior representative, addressing him/her by name. (b) If the award remains unpaid thirty (30) days after written request for payment, the company should send a copy of the letter to AF requesting assistance with the award payment. (c) AF will notify the non-paying company. (d) If the award remains unpaid for an additional thirty (30) days, the company may seek legal recourse in pursuit of collection and is entitled to statutory interests and all legal fees and costs incurred in pursuing collection until the award is paid. 5-3 Payments made as a result of the award are to be made only to the filing company. Payments must include any deductible interest, if applicable, in the interest of good will between the companies. In the Automobile and Property Subrogation programs, a filing company can file for supplemental damages paid after the Materials Due Date of the original hearing or anytime thereafter. In the PIP and Medical Payments programs, a filing company can file for supplemental damages paid after the initial filing, if these damages are contested by the responding company. In all programs, the original liability decision is res judicata. The sole issue in these filings is the supplemental damages. In Special Arbitration, if the original settlement of the claim is legally voided, the arbitration finding is nullified and the award payments must be returned.
