WHEREAS, Kirby A. Clark and Christine P. Clark of 821 E. Lisburn Road, Mwchawesrg,
PA 17055, is about to execute contemporaneously herewith, a contract, with Country Lane
Construction Company of 150 Pine Knob Rd., Newville, PA, for the erection of a building
upon premises commonly known as 821 E. Lisburn Road, Township of Upper Allen,
Cumberland County, Pennsylvania, as set forth in the deed dated 10/16/09, recorded at
Instrument Number 200936054, in the Recorder's Office for Cumberland County,
Pennsylvania, as more specifically described in Exhibit "A' which is incorporated herein and
attached hereto.
NOW, April 16, 2010, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor
to commence work on the said building, or purchase materials for the same in consideration
of the making of the said contract with Contractor and the further consideration of One
Dollar ($1.00), to contractor paid by Owner, it is agreed that no lien shall be filed against the
building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen
or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly
waived.
WITNESS, our hands and seals the day and year aforesaid.

EXHIBIT A
ALL THAT CERTAIN tract of land, with the improvements thereon, situate in Upper Allen
Township, Cumberland County, Pennsylvania, being identified as Lot 1 B in the "Final Subdivision
Plan of Klinedinst Farms for Esther M. Klinedinst and Rex P. Klinedinst", prepared by C. W . J unkins
Associates, Inc., dated May 25, 2005, duly approved by the Upper Allen Township Board of
Commissioners, and recorded September 18, 2006, in the Cumberland County Recorder of Deeds
Office in Plan Book 93, Page 26, and being more particularly bounded and described according to
said plan as follows:
BEGINNING at a point on the center line of Lisburn Road (S.R. 0114) at a common corner of Lots
IA and 1 B on the aforementioned plan, said point being located South 75° 43' 22" East 312.73 feet
from a magnetic nail at the intersection of the center lines of Lisburn Road (S.R. 0114) and
Klinedinst Road (S.R. 2015); thence along said Lot 1A, North 19° 334 East 657.36 feet to a point
on line of lands now or formerly of George H. Holder; thence along said lands, North 75° 16' 15"
East 421.49 feet to a point at the northwest corner of Lot 1C on the aforementioned plan; thence
along said Lot 1 C, South 26° 22'40" West 646.27 feet to a point; thence continuing along the same,
South 05° 58'42" West 229.44 feet to a point on the center line of Lisburn Road (S.R. 0114); thence
along the center line of Lisburn Road (S.R. 0114), North 75° 43'22" West 326.80 feet to a point at
the comer of Lot IA on the aforementioned plan, the point and place of beginning.
CONTAINING 5.035 acres according to the aforementioned plan, and having thereon erected a
two-story dwelling house.
UNDER AND SUBJECT to a right-of-way for the benefit of Lot IA on the aforementioned plan
for the purpose of ingress, egress and regress to and from Lot 1C on the aforementioned plan.
UNDER AND SUBJECT to any easements, restrictions, covenants, conditions, and other matters
of record, including those shown on the aforementioned plan; provided, however, that this deed shall
not revive any matters of record which have been fulfilled, released, expired, or otherwise removed.
