On 10/06/2003 mortgagor(s) made, executed and delivered a mortgage upon the premises
hereinafter described to WASHINGTON MUTUAL BANK, FA which mortgage is
recorded in the Office of the Recorder of CUMBERLAND County, in Mortgage Book
No. 1841, Page 0257. By Assignment of Mortgage recorded 04/03/2007 the mortgage
was assigned to PLAINTIFF which Assignment is recorded in Assignment of Mortgage
Book No. 735, Page 3059. The mortgage and assignment(s), if any, are matters of public
record and are incorporated herein by reference in accordance with Pa.R.C.P. 1019(g);
which Rule relieves the Plaintiff from its obligations to attach documents to pleadings if
those documents are of public record.
4. The premises subject to said mortgage is described as attached.
5. The mortgage is in default because monthly payments of principal and interest upon said
mortgage due 05/01/2009 and each month thereafter are due and unpaid, and by the terms
of said mortgage, upon failure of mortgagor to make such payments after a date specified
by written notice sent to Mortgagor, the entire principal balance and all interest due
thereon are collectible forthwith.

Plaintiff is not seeking a judgment of personal liability (or an in nersonam judgment)
against the Defendant(s) in the Action; however, Plaintiff reserves its right to bring a
separate Action to establish that right, if such right exists. If Defendant(s) has/have
received a discharge of personal liability in a bankruptcy proceeding, this Action of
Mortgage Foreclosure is in no way an attempt to reestablish such personal liability
discharged in bankruptcy, but only to foreclose the mortgage and sell the mortgaged
premises pursuant to Pennsylvania Law.
Notice of Intention to Foreclose as set forth in Act 6 of 1974, Notice of Homeowner's
Emergency Assistance Program pursuant to Act 91 of 1983, as amended in 1998, and/or
Notice of Default as required by the mortgage document, as applicable, have been sent to
the Defendant(s) on the date(s) set forth thereon, and the temporary stay as provided by
said notice has terminated because Defendant(s) has/have failed to meet with the Plaintiff
or an authorized consumer credit counseling agency, or has/have been denied assistance
by the Pennsylvania Housing Finance Agency.

WHEREFORE, Plaintiff demands an in rem judgment against the Defendant(s) in the sum of
$99,236.75, together with interest from 04/20/2010 at the rate of $12.22 per diem to the date of
judgment, and other costs, fees, and charges collectible under the mortgage and for the
foreclosure and sale of the mortgaged property.

Pennsylvania, bounded and described in accordance with a Subdivision Plan for Donald B. Rudy,
recorded in the Office of Recorder of Deeds for Cumberland County in Plan Book 38, Page 20,
as follows:
BEGINNING at a spike in the center line of Township Road T-454, at corner of land now or
formerly of Robert Martin; thence by said land now or formerly of Robert Martin, north 78
degrees 42 minutes 51 seconds East 363 feet to an iron pin; thence by other land now or formerly
of Donald B. Rudy, South 10 degrees 16 minutes 58 seconds East 675.21 feet to an iron pin;
thence by land now or formerly of John C. Foster, South 67 degrees 00 minutes West 322.45 feet
to an iron pin; thence by land now or formerly of Robert L. Kurtz, North 23 degrees 00 minutes
West 353.27 feet to an iron pin on the Eastern side of Township Road T-454 aforesaid, said iron

17011 the defendant was not found. Harry G. Raudabaugh is currently incarcerated at The Cumberland
County Prison. Deputies were advised, Harry G. Raudabaugh has filed bankruptcy under case number
1:09-bk-0471 1 -MDF.

PLAINTIFF'S MOTION TO REASSESS DAMAGES
Plaintiff, by its Attorneys, Phelan Hallinan & Schmieg, LLP, moves the Court to direct the
Prothonotary to amend the judgment in this matter, and in support thereof avers the following:
1. Plaintiff commenced this foreclosure action by filing a Complaint on April 23,
2010.
2. Judgment was entered on March 10, 2011 in the amount of $103,171.59. A true
and correct copy of the praecipe for judgment is attached hereto, made part hereof, and marked
as Exhibit "A".
3. Judgment against Donna J. Raudabaugh A/K/A Donna J. Landis is hereby
confirmed.

4. Pursuant to Pennsylvania Rule of Civil Procedure 1037(b)(1), a default judgment
containing a dollar amount must be entered for the amount claimed in the complaint and any item
which can be calculated from the complaint, i.e. bringing the interest current. However, new items
cannot be added at the time of entry of the judgment.
A Sheriffs Sale of the mortgaged property at 445 RUN ROAD, CARLISLE, PA
17015-7732 (hereinafter the "Property") was postponed or stayed for the following reason:
a.) Defendant Donna.l. Raudabaugh A/K/A Donna J. Landis filed a Chapter 07 Bankruptcy
at Docket Number 1:10-06535 on August 11, 2010. The Plaintiff obtained relief from the
bankruptcy stay by order of court dated September 10, 2010. A true and correct copy of the
Relief Order is attached hereto, made part hereof, and marked as Exhibit "B".
6. The Property is listed for Sheriffs Sale on September 7, 2011.
7. Additional surns have been incurred or expended on Defendants' behalf since the
Complaint was filed and Defendants have been given credit for any payments that have been made
since the judgment. The amount of damages should now read as follows:
Principal Balance $91,488.81
Interest Through September 7, 2011 $10,860.98
Per Diem $12.22
Late Charges $552.42
Legal fees $1,550.00
Cost of Suit and Title $1,325.00
Property Inspections/ Property Preservation $694.00
Escrow Deficit $5,336.99

The judgment formerly entered is insufficient to satisfy the amounts due on the
Mortgage.
9. Under the terms of the Mortgage and Pennsylvania law, Plaintiff is entitled to
inclusion of the figures set forth above in the amount of judgment against the Defendants.

10. Plaintiff's foreclosure judgment is in rem only and does not include personal
liability, as addressed in Plaintiff's attached brief.
11. In accordance with Cumberland County Local Rule 208.3(9), Plaintiff sent a copy of
its proposed Motion to Reassess Damages and Order to the Defendant on July 22, 2011 and
requested the Defendants' Concurrence. Plaintiff did not receive any response from the Defendants.
A true and correct copy of Plaintiff's letter pursuant to Local Rule 208.3(9) and certification of
mailing are attached hereto, made part hereof, and marked as Exhibit "C".
12. No judge has previously entered a ruling in this case.
WHEREFORE, Plaintiff respectfully requests that this Honorable Court amend the
judgment as requested.
