MILLER :CUMBERLAND COUNTY, PENNSYLVANIA A/K/A ESTHER SHENK MILLER ORPHANS' COURT DIVISION PETITION UNDER SECTION 3102 OF THE PROBATE, ESTATES AND FIDUCIARIES CODE FOR SETTLEMENT OF SMALL ESTATE TO THE HONORABLE JUDGES OF SAID COURT: Paul R. Miller, your Petitioner, files this Petition for Settlement of a Small Estate under the provisions of Section 3102 of the Probate, Estates and Fiduciaries Code and in support thereof avers that: (1) Your Petitioner, Paul R. Miller, is a competent adult residing at 39 Abbey Ct., Carlisle, Pennsylvania 17015, and is the spouse of the above decedent. (2) Esther V. Miller, a/k/a Esther Shenk Miller, spouse of the Petitioner, died on January 5, 2010, at the age of 88 years, but prior thereto lived and was domiciled at 39 Abbey Ct., Carlisle, Pennsylvania, Cumberland County, Pennsylvania. She died with a Will and no letters Testamentary have been issued. Last Will and Testament is attached hereto as Exhibit "A." (3) Esther V. Miller had no probate estate when she died other than the following: 75 Shares of Stock with Prudential Financial, Inc., valued at $3,959.25 as of her date of death. Statement from Prudential Financial, Inc., is attached hereto as Exhibit "B." (4) The sole heirs and next of kin and their relationship to the decedent are as follows: Paul R. Miller, Spouse R. Lee Shenk, Son Carl L. Shenk, Son Harold E. Shenk, Son (5) Your Petitioner avers that there are no creditors of the decedent and no claims unpaid known to your Petitioner. WHEREFORE, your Petitioner respectfully requests that an Order be made authorizing Prudential Financial, Inc., to transfer 75 Shares of Stock to Paul R. MILLER, of South Middleton Township, Cumberland County, Pennsylvania, declare this instrument to be my last will and testament, hereby expressly revoking all wills and codicils heretofore made by me. 1. I direct my executor to pay all of my debts, funeral and administrative expenses as soon as may be done conveniently after my decease. 2. I authorize and empower my executor to sell any realty owned by me at my death and not specifically devised herein, at either public or private sale, and to give good and sufficient deeds therefor, in fee simple, as I could do if 1 iving. 3. I devise and bequeath all of my estate of every nature and wherever situate to my husband, Paul R. Miller, providing he shall survive me by sixty days.. 4. Should the gift in Paragraph No. 3 not take effect, I devise and bequeath all of my estate of every nature and wherever situate to my three sons, Robert Lee Shenk, Carl Lynn Shenk and Harold Eugene Shenk, share and share alike, the child or children of any son taking the share their parent would have taken if 1 iving. 5. I nominate and appoint Paul R. Miller to be the executor of this my last will and testament; he is to serve as such without bond. Should he die before my death, renounce or 3881 refuse to serve for any reason, or die leaving any of my estate unadministered, I nominate and appoint Robert Lee Shenk, Carl Lynn Shenk and Harold Eugene Shenk, as substitute executors, also to serve as such without bond, with the same powers as are given herein to my executor. 6. I hereby suggest that my personal representative retain the services of Irwin, Irwin & McKnight, as attorneys in the settlement of my estate.
