On 04/09/1999 JEREMY L. AYERS made, executed and delivered a mortgage upon the
premises hereinafter described to PLAINTIFF which mortgage is recorded in the Office
of the Recorder of CUMBERLAND County, in Book No. 1534, Page 469. The mortgage
and assignment(s), if any, are matters of public record and are incorporated herein by

The premises subject to said mortgage is described as attached.
The mortgage is in default because monthly payments of principal and interest upon said
mortgage due 08/01/2009 and each month thereafter are due and unpaid, and by the terms
of said mortgage, upon failure of mortgagor to make such payments after a date specified
by written notice sent to Mortgagor, the entire principal balance and all interest due
thereon are collectible forthwith.

Plaintiff is nat seeking a judgment of personal liability (or an in nersonam judgment)
against the Defendant(s) in the Action; however, Plaintiff reserves its right to bring a
separate Action to establish that right, if such right exists. If Defendant(s) has/have
received a discharge of personal liability in a bankruptcy proceeding, this Action of
Mortgage Foreclosure is in no way an attempt to reestablish such personal liability
discharged in bankruptcy, but only to foreclose the mortgage and sell the mortgaged
premises pursuant to Pennsylvania Law.
Notice of Intention to Foreclose as set forth in Act 6 of 1974, Notice of Homeowner's
Emergency Assistance Program pursuant to Act 91 of 1983, as amended in 1998, and/or
rile #: 227058
Notice of Default as required by the mortgage document, as applicable, have been sent to
the Defendant(s) on the date(s) set forth thereon, and the temporary stay as provided by
said notice has terminated because Defendant(s) has/have failed to meet with the Plaintiff
or an authorized consumer credit counseling agency, or has/have been denied assistance
by the Pennsylvania Housing Finance Agency.
9. Notice of Intention to Foreclose pursuant to Act 6 of 1974 is not required because the
defendants are not "Residential Mortgage Debtors" as defined by the Act, having failed to
provide Plaintiff notice of its acquisition of title.
10. This action does not come under Act 91 of 1983 because the mortgaged premises is not
owner-occupied.
11. Mortgagor JEREMY L. AYERS died on 9/9/09, and STEPHANIE AYERS and STACI L.
HAIR were appointed Co-Administrators of his estate. Letters of Administration were
granted to them on 10/12/09 by the Register of Wills of Cumberland County, No. 2109-
0953. Decedent's surviving heir at law and next-of-kin are JESSICA AYERS and AVERIE
MARIE AYERS.
12. Plaintiff does not hold the named Defendant(s), STEPHANIE AYERS, STACI L. HAIR,
AVERIE MARIE AYERS, and JESSICA AYERS, personally liable on this cause of
action. This action is being brought to foreclose the interest of the said Defendant(s) in
the aforesaid real estate only, and the Defendant(s) has/have been named in accordance
with the requirements of Pa R.C.P. I I44(a)(2) and 20 Pa.C.S.A. § 301(b).

WHEREFORE, Plaintiff demands an in rem judgment against the Defendant(s) in the sum of
$49,141.07, together with interest from 01/04/2010 at the rate of $6.76 per diem to the date of
judgment, and other costs, fees, and charges collectible under the mortgage and for the
foreclosure and sale of the mortgaged property.

Honorable Court to make Rule to Show Cause absolute in the above-captioned action, and in
support thereof avers as follows:
A Motion to Reassess Damages was filed with the Court on March 24, 2011.
2. In accordance with Cumberland County Local Rule 208.3(9), Plaintiff sent a copy of
its proposed Motion to Reassess Damages and Order to the Defendant on March 14, 2011 and
requested the Defendants' Concurrence. Counsel for the Defendants sent Plaintiff's representative
an email on March 18, 2011, in which she states she concurs with Plaintiff's requested relief. A true
and correct copy of Plaintiff's letter pursuant to Local Rule 208.3(9) and certification of mailing are
attached hereto, made part hereof, and marked as Exhibit "A".
A Rule was issued by the Honorable J. Wesley Oler, Jr. on or about March 28,
2011 directing the Defendants to show cause why the Motion to Reassess Damages should not
be granted. A true and correct copy of the Rule is attached hereto, made part hereof, and marked
Exhibit B.
4. The Rule to Show Cause was timely served upon all parties on April 5, 2011 in
accordance with the applicable rules of civil procedure. A true and correct copy of the

It is hereby stipulated and agreed by and between counsel for Plaintiff, and The United States of America, as
follows:
1. That the premises known as 29 MOUNTAIN STREET, MOUNT HOLLY SPRINGS, PA 17065,
was owned by Jeremy L. Ayers.

2. That on 04/09/1999, Defendants, JEREMY L. AYERS made, executed, and delivered a
Mortgage upon the premises, which mortgage is recorded in the Office for the Recorder of Deeds of
CUMBERLAND County in Mortgage Book Book: 1534 Page: 469. Said Mortgage is attached
hereto and marked as Exhibit "A".
3. Mortgagor JEREMY L. AYERS died on 9/9/09, and STEPHANIE AYERS and STACI L. HAIR
were appointed Co-Administrators of his estate. Letters of Administration were granted to them on
10/12/09 by the Register of Wills of Cumberland County, No. 2109-0953. Decedent's surviving
heirs at law and next-of-kin are JESSICA AYERS and AVERIE MARIE AYERS.
4. That Plaintiff filed an action in mortgage foreclosure against the defendant on 05/10/2010 a true and
correct copy of which is attached hereto and marked as Exhibit "B".
5. That Plaintiff has subsequently discovered that the premises is encumbered by a Federal Tax Lien
as set forth in the true and correct copy of the Notice of Federal Tax Lien attached hereto and
marked as Exhibit "C".
6. That the Federal Tax Lien asset forth in Exhibit "C" is junior to plaintiffs mortgage.
7. That the Complaint is hereby amended nunc pro tunc to reflect the Federal Tax Lien as set forth in
Exhibit "C" as required by 28 U.S.C. Section 2410 (b) and that the United States of America is
made a defendant herein pursuant to 28 U.S.C. Section 2410.
8. That The United States of America is not indebted to the plaintiff.
9. That The United States of America agrees to service of the complaint, as herein amended, and entry
of this action of judgment in favor of the Plaintiff and against The United States of America for
foreclosure and sale of the mortgaged premises.
10. That the premises shall be sold at a judicial sale notice of which will be provided to the United
States of America in compliance with Pennsylvania Rule of Civil Procedure, Rule 3129.2.
11. That the judicial sale of said premises shall discharge the federal lien referred to in Exhibit "C".
12. That the proceeds of the sale shall be divided and distributed as the parties may be entitled.
13. That the United States of America preserves its right of redemption as provided in 28,
U.S.C. Section 2410(c).
14. That the parties to this Stipulation shall bear their own respective costs in this proceeding.

11. Mortgagor JEREMY L. AYERS died on 9/9/09, and STEPHANIE AYERS and STACI L.
HAIR were appointed Co-Administrators of his estate. Letters of Administration were
granted to them on 10/12/09 by the Register of Wills of Cumberland County, No. 2109-
0953. Decedent's surviving heir at law and next-of-kin are JESSICA AYERS and AVERIE
MARIE AYERS.
12. Plaintiff does not hold the named Defendant(s), STEPHANIE AYERS, STACI L. HAIR,
AVERIE MARIE AYERS, and JESSICA AYERS, personally liable on this cause of
action. This action is being brought to foreclose the interest of the said Defendant(s) in
the aforesaid real estate only, and the Defendant(s) has/have been named in accordance
with the requirements of Pa R.C.P. I I44(a)(2) and 20 Pa.C.S.A. . § 301(b).
