WHEREAS, Land 0' Lakes, Inc., of 4001 Lexington Avenue North, Arden Hills, Minnesota 55126,
is about to enter into a contract with R. S. Mowery & Sons, Inc., of 1000 Bent Creek Boulevard,
Mechanicsburg, Pennsylvania, 17050 for the construction of the Wastewater Equalization and DAF
Upgrade Project located at 405 Park Drive, South Middleton Township, Carlisle, Cumberland County,
Pennsylvania.
NOW, May 10, 2010, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Land 0' Lakes, Inc., to the said R. S.
Mowery & Sons, Inc., to commence work on the said building, or purchase materials for the same
in consideration of the making of the said contract with R. S. Mowery & Sons, Inc., and the further
consideration of One Dollar to R. S. Mowery & Sons, Inc., paid by Land 0' Lakes, Inc., it is agreed
that no lien shall be filed against the building or property by the contractor, nor any subcontractor,
nor by any of the material men or workmen nor any other person for any labor, or materials
purchased, or extra labor or materials purchased for the completion of said building, the right to file
such liens being expressly waived.
