COMPLAINT
1.Plaintiff Selective Insurance Company of America (herein "Selective 324
Ins. Co.") is an insurance carrier licensed and authorized to perform business within
the Commonwealth of Pennsylvania and having as one of its principal places of
business the above captioned address.
2.Plaintiff Gabriel Wagner is an adult individual who resided at 208 `/2 Reno
Avenue Apt. 2, New Cumberland, Pennsylvania at all time relevant to the present
matter.
3.Defendant Timothy A. Noel is an adult individual residing at the above
captioned address.
4.On or about July 4, 2009, the Defendant Timothy A. Noel resided at or near
212 S. Reno Avenue, New Cumberland, PA 17070.
5.On or about July 4, 2009, The Plaintiff Selective Insurance Co. insured
Gabriel Wagner under a personal auto policy of insurance with the Plaintiff Selective
Insurance Company of America, policy # F 5095590, covering a 1999 Pontiac Grand
Am and carrying with same, collision coverages.
6.On or about July 4, 2009, a fire erupted 212 S. Reno Avenue, New
Cumberland, PA 17070 and resulted in damages to Plaintiff insured's parked 1999
Pontiac Grand Am in the amount of $ 4,340.93.
7.The fire originated at the result of the negligence of the tenant Timothy A.
Noel who left chicken frying on the stove unattended.
8.The negligence of the Defendant consisted of:
a) Failing to monitor an open flame and/or stove;
b) Failing to warn Plaintiff of danger;
c) Failing to properly dispose of combustibles;
d) Failing to make proper observations;
e) Negligent entrustment;
f) Failing to take proper safety precautions;
g) being inattentive;
h) failing to promptly extinguish fire;
i) failing to install, and or maintain working fire and/or smoke alarms;
j) leaving a burning instrument unattended;
k) other such negligence that may be developed through continuing
discovery and trial of this matter.
9. The aforesaid property damage resulted solely from the negligent acts
and/or failure to act on part of Defendant named herein and were due in no manner
whatsoever to any act and/or failure to act on part of Plaintiffs.
I O.As a result of the aforesaid fire, Plaintiff was forced to incur property
damage in the amount of $4340.93 ( said figure includes Plaintiff's first party
deductible ) representing fair and reasonable reimbursement for the damages
sustained.
11.The Plaintiff Selective Insurance Company is subrogated to the Plaintiff
Gabriel Wagner.
WHEREFORE, Plaintiffs demand judgment against the Defendant in the
amount of $ 4,340.93 together plus costs.
