COMPLAINT
Plaintiff, Kaitlyn Laughlin, by and through her counsel, JAMES, SMITH, DIETTERICK
& CONNELLY, LLP, brings this action against the Defendant, Aaron W. Wiskeman, in support
of which she avers as follows:
Parties
1. Plaintiff, Kaitlyn Laughlin (hereinafter "Plaintiff '), is an adult individual residing
at 2 Bittersweet Lane, Mechanicsburg, Cumberland County, Pennsylvania, 17050.
2. Upon information and belief, Defendant, Aaron W. Wiskeman (hereinafter
"Defendant"), is an adult individual residing at 486 Petersburg Road, Carlisle, Cumberland
County, Pennsylvania 17015
Venue and Jurisdiction
3. Venue is proper in this judicial district pursuant to Pa. R.C.P. 1006.
4. The monetary damages claimed by Plaintiff in the instant action exceed the
jurisdictional limit for compulsory arbitration pursuant to the Local Rules of this Court.
Factual Background
5. On November 10, 2008, Plaintiff was the operator of a 2008 BMW bearing
Pennsylvania license plate GYX-1569.
6. On November 10, 2008, Defendant was the owner and operator of a 1988 Ford
bearing Pennsylvania license plate YNF-7485.
7. On November 10, 2008, at approximately 3:00 p.m., Plaintiff was operating a
motor vehicle in a westbound direction on Gettysburg Road, Cumberland County, Pennsylvania,
and stopped her vehicle in a westbound direction, intending to make alert-hand turn onto Rana
Villa Avenue.
8. On the above date and time, Defendant, Aaron W. Wiskeman, was operating a
motor vehicle in the westbound direction on Gettysburg road, Cumberland County,
Pennsylvania, near its intersection with Rana Villa Avenue, Cumberland County, Pennsylvania.
9. As Plaintiff was stopped in the aforementioned location, her motor vehicle was
suddenly and unexpectedly struck from behind by the motor vehicle being operated by
Defendant, causing the injuries, damages and losses set forth below.
COUNT I -NEGLIGENCE
10. Paragraph Nos. 1 through 9 are incorporated herein by reference as if fully set
forth below.
11. The aforementioned collision occurred solely as the result of the negligence,
recklessness and carelessness of Defendant, Aaron W. Wiskeman, and was due in no manner
whatsoever to any act or failure to act on the part of Plaintiff, Kaitlyn Laughlin, or any other
person or entity.
12. The aforementioned negligence, recklessness and carelessness of Defendant
consisted of the following:
(a) Operating a motor vehicle in careless disregard for the safety of persons
and property of others in violation of 75 Pa. C.S.A. § 3714;
(b) Operating a motor vehicle in a reckless manner in violation of 75 Pa.
C.S.A. § 3736(a);
(c) Operating a motor vehicle at an unsafe speed in violation of 75 Pa. C.S.A.
§ 3361;
(d) Failing to yield the right-of--way to another vehicle in violation of 75 Pa.
C.S.A. § 3322;
(e) Failing to keep a proper lookout for motor vehicles before crossing an
intersection;
(f) Failing to operate a motor vehicle in such a manner as to avoid causing a
collision; and
(g) Failing to keep his motor vehicle under reasonable control;
(h) Failing to observe the presence and direction of Plaintiff's vehicle when
the Defendant knew, or should have known, of the presence of Plaintiff s
vehicle.
13. As a direct and proximate result of the negligence, carelessness and recklessness
of Defendant, Aaron W. Wiskeman, Plaintiff, Kaitlyn Laughlin, suffered the following injuries,
some or all of which maybe permanent:
(a) Neck injury;
(b) Upper mid back injury;
(c) Lower back injury on her right side;
(d) Right knee injury; and
(e) Miscellaneous aches and pains.
14. As a direct and proximate result of the negligence, carelessness and recklessness
of Defendant, Aaron W. Wiskeman, Plaintiff, Kaitlyn Laughlin, has required medical treatment
and has incurred expenses in connection therewith for medicines, medical care, hospitalization
and other medical services for which a claim is hereby made.
15. As a direct and proximate result of the negligence, recklessness and carelessness
of the Defendant, Aaron W. Wiskeman, Plaintiff, Kaitlyn Laughlin, has suffered in the past and
may in the future continue to suffer excruciating and agonizing aches, pains, mental anguish,
humiliation, embarrassment, loss of life's pleasures, and severe limitation in her pursuit of daily
activities for which a claim is hereby made.
16. As a direct and proximate result of the negligence, recklessness and carelessness
of the Defendant, Aaron W. Wiskeman, Plaintiff, Kaitlyn Laughlin, has in the past been and may
in the future be disabled from performing her usual duties, occupations, and avocations with a
consequent loss of earnings, earning power and earning potential for which a claim is hereby
made.
WHEREFORE, Plaintiff, Kaitlyn Laughlin, demands damages of Defendant, Aaron W.
Wiskeman, in an amount in excess of the amount required for compulsory arbitration pursuant to
the Local Rules of this Court, plus costs of suit and delay damages.
