Richards, Esquire, and moves this Honorable Court to permit him to withdraw as counsel and in support thereof states as follows: 1. The Executor of the estate, David A. Paxton, has failed to cooperate with counsel in making final distribution of the estate as required by law. 2. Despite numerous efforts, undersigned counsel has been unable to communicate with Mr. Paxton concerning this action. 3. Undersigned counsel last attempted to contact Mr. Paxton by letter dated January 6, 2006. Mr. Paxton has not contacted undersigned counsel. 4. Undersigned counsel is unable to continue to represent the Executor in this action because of his lack of cooperation. WHEREFORE, Kevin M.
