You have been sued in Court. If you wish to defend against the claims set forth
in the following pages, you must take prompt action. You are warned that if you fail to
do so, the case will proceed without you and a decree in divorce or annulment may be
entered against you for any other claim or relief requested in these papers by the
Plaintiff. You may lose money or property or other rights important to you, including
custody or visitation of your children.
When the ground for the divorce is indignities or irretrievable breakdown of the
marriage, you may request marriage counseling. A list of marriage counselors is
available in the Office of the Prothonotary at the First Floor, Cumberland County
Courthouse, South Hanover Street, Carlisle, Pennsylvania 17013.

COMPLAINT IN DIVORCE
1. Plaintiff is EILEEN P. SAVAGE, an adult individual, currently residing at
1837% Sterretts Gap Avenue, Carlisle, Cumberland County, Pennsylvania.
2. Defendant is ALBERT P. RADTKE, JR., an adult individual, last known
addresses are PO Box 402, Lake Como, Florida 32157 and 455 Atlantic Blvd, Atlantic
Beach, Florida 32233.
3. Plaintiff is a bonafide resident of the Commonwealth of Pennsylvania and
has been so for at least six months immediately previous to the filing of this complaint.
4. Plaintiff and Defendant were married on March 11, 2002 in Cumberland
County, Pennsylvania.
5. There have been no prior actions for divorce or annulment between the
parties.
6. The Defendant is not a member of the Armed Forces of the United States
of America, or its Allies.
7. The Plaintiff has been advised of the availability of counseling and the
right to request that the Court require the parties to participate in counseling. Knowing
this, the Plaintiff does not desire that the Court require the parties to participate in
counseling.
8. Plaintiff and Defendant are citizens of the United States of America.
9. The parties have lived separate and apart since July 18, 2002 and
continue to live separate and apart as of the date of this Complaint.
10. The parties' marriage is irretrievably broken.
11. Plaintiff desires a divorce based upon the belief that Defendant will, after
ninety days from the date of the filing of this Complaint, consent to this divorce.

divorce.

PETITION FOR SERVICE BY PUBLICATION
1. Plaintiff is EILEEN P. SAVAGE, an adult individual, currently residing at
1837% Sterretts Gap Avenue, Carlisle, Cumberland County, Pennsylvania.
2. Defendant is ALBERT P. RADTKE, JR., an adult individual, last known
addresses are P.O. Box 402, Lake Como, Florida 32157; 455 Atlantic Blvd., Atlantic
Beach, Florida 32233; and General Delivery, Kerrville, TX 78028.
3. The marriage between Ms. Savage and Mr. Radtke was of only four
months duration and resulted in no children. Ms. Savage has had no contact with Mr.
Radtke for over two years. There is no property at issue.
4. According to defendant's marriage license, his birthplace was Chicago, IL,
but no valid address in that area for Mr. Radtke has resulted from phone calls or
associated research.
5. Defendant's addresses were ascertained by AH. "Buck" Shuller, a
licensed private investigator, between February and August 2004.
6. The Plaintiffs Divorce Complaint was filed June 17th, 2004; and reinstated
November 8,2004.
7. On June 18th, 2004, copies of the complaint were mailed to the defendant
at the Florida addresses shown above by both regular and certified mail.
8. All copies of the complaint were returned undelivered by the U.S. Post
Office.
9. The certified letter to the P.O Box was marked "Unclaimed," and the
others were marked "Moved, Left No Address."
10. On June 22, 2004, another attempt was made to contact the defendant
through the P.O. Box discovered by the investigator.
11. That letter was returned marked "Attempted-Not Known."
12. On August 4, 2004, copies of the complaint were mailed to the defendant
at the Texas address shown above by both regular and certified mail.
13. Both copies of the complaint were marked "Unclaimed" and returned
undelivered by the U.S. Post Office.
14. Copies of all investigative reports and resulting attempts at service are
attached as exhibits.
15. Plaintiff has no other means of contacting defendant.
16. In accordance with rules set out in 42 Pa.C.S. 9430, plaintiff proposes to
serve notice of the above-referenced complaint on defendant, as shown in Exhibit A, by
publication in an appropriate newspaper in Kerr County, TX.
Wherefore, petitioner requests that this court permit the complaint in this
action to be made by publication as stated in Exhibit A.

AFFIDAVIT IN SUPPORT OF SERVICE BY PUBLICATION
I certify that since the action at issue was filed with the Cumberland County
Prothonotary's office on June 17th, 2004, seven attempts have been made to serve the
defendant at his last known addresses, three of those by certified mail. All of those
attempts have been unsuccessful. The addresses were the result of inquiries by a
licensed private investigator.
Service cannot be made on the defendant under the applicable rule because the
whereabouts of the defendant cannot be reasonably ascertained despite diligent and
good faith efforts. Addresses for the defendant gained through investigation have not
proved current.

PETITION FOR SERVICE BY PUBLICATION
1. Plaintiff is EILEEN P. SAVAGE, an adult individual, currently residing at
1837% Sterretts Gap Avenue, Carlisle, Cumberland County, Pennsylvania.
2. Defendant is ALBERT P. RADTKE, JR., an adult individual, last known
addresses are P.O. Box 402, Lake Como, Florida 32157; 455 Atlantic Blvd., Atlantic
Beach, Florida 32233; and General Delivery, Kerrville, TX 78028.
3. The marriage between Ms. Savage! and Mr. Radtke was of only four
months duration and resulted in no children. Ms. Savage has had no contact with Mr.
Radtke for over two years. There is no property at issue.
4. According to defendant's marriage license, his birthplace was Chicago, IL,
but no valid address in that area for Mr. Radtkl3 has resulted from phone calls or
associated research.
5. Defendant's addresses were ascertained by A.H. "Buck" Shuller, a
licensed private investigator, between February and August 2004.
6. The Plaintiff's Divorce Complaint was filed June 17th, 2004; and reinstated
November 8, 2004.
7. On June 18th, 2004, copies of the complaint were mailed to the defendant
at the Florida addresses shown above by both regular and certified mail.
8. All copies of the complaint were returned undelivered by the U.S. Post
Office.
9. The certified letter to the P.O Box was marked "Unclaimed," and the
others were marked "Moved, Left No Address."
10. On June 22, 2004, another attempt was made to contact the defendant
through the P.O. Box discovered by the investigator.
11. That letter was returned marked "Attempted-Not Known."
12. On August 4,2004, copies of the complaint were mailed to the defendant
at the Texas address shown above by both regular and certified mail.
13. Both copies of the complaint were! marked "Unclaimed" and returned
undelivered by the U.S. Post Office.
14. Copies of all investigative reports and resulting attempts at service are
attached as exhibits.
15. Plaintiff has no other means of contslcting defendant.
16. In accordance with rules set out in 42 Pa.C.S. 9430, plaintiff proposes to
serve notice of the above-referenced complaint on defendant, as shown in Exhibit A, by
publication in an appropriate newspaper in Kerr County, TX.
Wherefore, petitioner requests that this court permit the complaint in this
action to be made by publication as stated in Exhibit A.

I certify that since the action at issue was filed with the Cumberland County
Prothonotary's office on June 17th, 2004, seven attempts have been made to serve the
defendant at his last known addresses, three of those by certified mail. All of those
attempts have been unsuccessful. The addresses were the result of inquiries by a
licensed private investigator.
Service cannot be made on the defendant under the applicable rule because the
whereabouts of the defendant cannot be reasonably ascertained despite diligent and
good faith efforts. Addresses for the defendant gained through investigation have not
proved current.
