EDWIN BERKHEIMER, Contractor :IN THE COURT OF COMMON PLEAS :OF CUMBERLAND COUNTY, PENNSYLVANIA :Number Term, 2001 WHEREAS, THOMAS W. RIDER and STEPHANIE M. RIDER, of Cumberland County, Pennsylvania are about to execute contemporaneously herewith, a contract, with H. EOWIN BERKrlEIMER, of Cumberland County, Pennsylvania, for the erection of a building upon a lot of land situate, lying and being in Silver Spring Township, Cumberland County, Pennsylvania, bounded and limited in accordance with Exhibit "A" attached hereto; NOW, THEREFORE, on November 19, 2{]{31, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Centracter to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of One ($1.00) Dollar, to Contractor paid by Owner, it is agreed that no lien shall be filed against the building andlor land by the contractor, or any subcontractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. RIDER ALL THAT CERTAIN lot of unimproved land situated in the Township of Silver Spring, County of Cumberland and Commonwealth of Pennsylvania, more particularly bounded and described as follows: BEGINNING at a point on the western dedicated right-of-way line of Keystone Drive at the dividing line between Lots Nos. 22 and 23 as shown on the hereinafter mentioned Plan of Lots; thence along said dividing line between Lots Nos. 22 and 23, South 64 degrees 36 minutes 30 seconds West, a distance of 184.50 feet to a point at the dividing line between Lots Nos. 22 and 31 as shown on said Plan of Lots; thence along said dividing line between Lots Nos. 22 and 31, the following two (2) courses and distances: (a) North 31 degrees 20 minutes West, a distance of 144.75 feet to a point; and (b) North 6 degrees 40 minutes East, a distance of 210.48 feet to a point at the dividing line between Lots Nos. 22 and 21 as shown on said Plan of Lots; thence along said dividing line between Lots Nos. 22 and 21, South 67 degrees 9 minutes East, a distance of 232.10 feet to a point on the western dedicated right-of-way line of Keystone Drive; thence along said western dedicated right-of-way line of Keystone Drive in a southwardly direction on a curve to the right having a radius of 200 feet, a distance of 168.41 feet to a point on the same at the dividing line between Lots Nos. 22 and 23 as shown on the hereinafter mentioned Plan of Lots, the place of BEGINNING. BEING Lot No. 22 as shown on a certain Plan of Lots entitled "Final Subdivision of Enchanted Hills" as recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 76, Page 37. THE ABOVE DESCRIBED lot is conveyed under and subject, nevertheless, to: (1) The building set-back lines and utility easements and drainage easements, if any, as more fully shown, located and defined on the above mentioned Plan of Lots; (2) The applicable restrictions, covenants and conditions as more fully set forth on the above mentioned Plan of Lots. (3) The easements and rights-of-way heretofore granted to public utility companies for the use of providing utility services to the subdivision shown on the above described Plan of Lots; and (4) The restrictions, conditions and covenants as more fully set forth in a certain Amended Declaration of Covenants and Restrictions dated January 15, 1999, and recorded in the Recorder's Office aforesaid in Misc.
