FAMILY SETTLEMENT AND FINAL DECEASED THE ESTATE
OF DAVID NOAH BAIR, D
Know that David Noah Bair, late of New Cumberland, Cumberland
County, deceased, died testate on August 17, 2009, having first made his
Last Will and Testament that was duly executed o 20 9r 00818 007, and is
duly recorded in Cumberland County under number ,
WHEREAS, David Noah Bair, by his Last Will and Testament,
named his wife, Doris Mae Bair as Executrix of his Last Will and
Testament;
WHEREAS, Letters Testamentary on the Estate of David Noah Bair
were duly issued by the Register of Wills of Cumberland County,
Pennsylvania, to the Executrix;
WHEREAS, the Executrix has gathered the assets of the Estate of
David Noah Bair and the assets consist of p tatement of Account thattis
value of $ 169,379.00, as set forth m the S
attached hereto as "Exhibit A";
WHEREAS, the Executrix has paid the debts of the Estate in the
amount of $16,846.00, leaving a balance for distribution of $152,533.00, as
set forth in Exhibit A;
WHEREAS, the balance for distribution as shown in Exhibit A has
been distributed in accordance with the terms of the Last Will and Testament
of David Noah Bair;
NOW, THEREFORE, we, Doris Mae Bair, the wife and a
beneficiary of the Decedent, David Noah Bair, and Phillip Dennis Bair, the
child and a beneficiary of David Noah Bair, each of us, acknowledge that we
have this day received all money, legacies, bequests, and devises as ~r~
given, devised, and bequeathed to each of us in accordance wi~ the L ~`;

Will and Testament of David Noah Bair, as set forth in the St~,t=~nrent

AND, we, Doris Mae Bair and Phillip Dennis Bair, do hereby
stipulate that to avoid the expense and time involved in the filing of a formal
account and schedule of distribution, we agree that no account is necessary
and we agree that we consent to the distribution being made without the
formal filing of an account and schedule of dsshad been filed and confirmed
the same force and effect as if the document
by the Orphans' Court Division of the Court of Cumberland County,
Pennsylvania.
THEREFORE, we do each hereby release, quitclaim, and forever
discharge the Executrix, David Noah Bair's heirs, Timothy A. Holmes, their
executors, administrators and assigns, from all actions, suits, payments,
accounts, reckonings, and claims touching upon the Estate of David Noah
Bair. And, each of us do hereby covenant and agree that should any liability
come due to the estate of David Noah Bair after signing this agreement, we
do hereby covenant and agree with each other that we will contribute pro
rata our share of the estate to satisfy any and all claims, demands, suits, or
causes of action which may be successfully prosecuted against the estate or
personal representative after the signing, sealing, and delivery of this family
settlement agreement and final release.
