HESS Plaintiffs vs. KEVIN HILTZ AND JALENA GOLDSTEIN Defendants IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA NO. 10-3628 CV CIVIL TERM 102 Centerfield Drive, Harrisburg, PA 17112. 2. The Defendants, Kevin Hiltz and Jalena Goldstein, are adult individuals, residing at 130 Adelia Street; Apartment /Suite 7, Middletown, Pa. 17057. 3. On or about July 1, 2008, Plaintiffs and Defendants entered into a Rental Agreement by which Defendants agreed to rent the premises at 213 Clay Street, West Fairview, East Pennsboro Township, Pennsylvania 17025, a true and correct copy of which is attached hereto, as Exhibit "A." 4. Defendants were required by the Rental Agreement to pay rent in the amount of $830.00 plus certain utilities per month to the Plaintiffs. 5. Defendants were required to maintain the interior and exterior of the premises in a neat and clean condition, including maintaining the lawn and landscaping. 6. Said Rental Agreement has not been assigned by Plaintiffs. 7. The Defendants have violated the Rental Agreement by breaching their obligations under the same as follows: (a.) Defendants did not pay the rent and utilities owed for June, 2009 and August 2009. (b.) Defendants left the aforesaid rental unit in an unclean condition. (c.) Defendants left a second floor radiator in the aforesaid unit coated with caked-on cat feces. (d.) Defendants left walls, ceilings and fixtures in the aforesaid rental unit unclean and coated with smoke. (e.) Defendants left personal items in and on the premises after move-out, which items forced Plaintiffs to incur expenses for storage and removal. (f.) Defendants damaged several window screens in the aforesaid rental unit. (g.) Defendants failed to mow the lawn, pull the weeds and maintain the exterior of the premises, allowing the lawn and weeds to become too long to the point where they could be repaired only at extra expense to the Plaintiffs. (h.) In addition, the Defendants returned the premises to the Plaintiffs with debris such as glass bottles, wood, and old broken furniture accumulated among and buried in the overgrown vegetation. (i.) Defendants damaged doors, door frames, a door plunger, a door handle and a door stop in the aforesaid rental unit. (j.) Defendants damaged flooring of the aforesaid rental unit. (k.) Defendants damaged miniblinds in the aforesaid rental unit and removed a miniblind that was part of the aforesaid rental unit. . (1.) Defendants damaged the kitchen counter top in the aforesaid rental unit. (m.) Defendants damaged the kitchen cabinets in the aforesaid rental unit. (n.) Defendants broke windows in the aforesaid rental unit and removed a window that was part of the aforesaid rental unit. (o.) Defendants damaged walls in the aforesaid rental unit. (p.) Defendants damaged acustom-built desk and window trim in the aforesaid rental unit. (q.) Defendants removed the basement handrail that was part of the aforesaid rental unit. (r.) Defendants did not return the aforesaid rental unit with greater than'/a tank of oil as required by the Rental Agreement. (s.) Defendants did not purchase a furnace service policy and have the furnace cleaned as required by the Rental Agreement. 8. Defendants' damage to the rental unit caused the premises to be unrentable, causing the Plaintiffs to lose income. 9. Defendants are required to pay Plaintiffs' attorney fees pursuant to the Rental Agreement. 10. Plaintiffs are expected to incur attorney fees in the amount of $2,500.00 for the purpose of collecting amounts due from the Defendants. 11. Plaintiffs have been forced to incur filing fees at the District Justice office in the amount of $210.50 for the purpose of obtaining judgment against Defendants. 12. Plaintiffs have been forced to perform and incur repair costs as a result of Defendants' damage. 13. Plaintiffs have been forced to perform and incur costs for cleaning and junk removal to clean up dirt and remove debris left behind by the Defendants and to repair damages caused by the Defendant. 14. Plaintiffs have been forced to perform and incur costs to remove trash and clean up the exterior of the premises and to pull weeds and mow the lawn due to the condition that the Defendants left the exterior of the premises. 15. Plaintiffs have suffered lost rent as a result of the damages to Plaintiffs' real estate. 16. The Rental Agreement concerns the property of 213 West Clay Street, West Fairview, East Pennsboro Township, Pennsylvania 17025 (the property). 3. The term of the lease in the Rental Agreement was from July 1, 2008 until July 31, 2009. 4. Before the end of the lease, both Plaintiffs and Defendants showed the property to prospective new tenants. 5. Defendants moved out of the property on July 1, 2009. 6. Defendant Hiltz surrendered the keys to the property to Plaintiff Troy D. Hess within one week of moving out of the property. See Adamsky v. Picknick, 603 A.2d 1069,1071 (Pa.Super.1992)(vacant premises and tender of keys is surrender). 7. Plaintiffs never returned Defendants their security deposit of $818.33. 8. Plaintiffs never provided Defendants with a written list of damages to the property. 9. Plaintiffs were required to "provide tenant with a written list of any damages to the leasehold premises" within "thirty days of termination of a lease or upon surrender and acceptance of the leasehold premises ... " 68 P.S. § 250.512(a). 10. Because Plaintiffs failed to provide a timely, written list of damages to Defendants, Plaintiffs forfeited "all rights ... to bring suit against the tenant[s] for damages to the leasehold premises." 68 P.S. § 250.512(b).
