Weaver & Son Inc. and Penn Hershey Transfer (PUC No. A-00113647 and in support thereof, alleges as follows: JURISDICTION This matter arises from an appeal from a judgement of the Honorable Charles A. Clement, Jr., Magisterial District No. 9-1-01. The notice of appeal was time of lodged with the Cumberland County Court of Common Pleas on 6/312010. PARTIES 1.} Plaintiff Kathleen S. Sandnes, an individual residing at 228 Poplar Ave., New Cumberland, PA 17070. 4 2.) Defendant Harrisburg Storage Company, Geo. W. Weaver & Son Inc. and Penn Hershey Transfer are businesses residing at 165 Lamont St., New Cumberland, PA 17070. BACKGOUND 3.) During July of 2009, Plaintiff and Defendant entered into a shipping agreement (Exhibit A) in the amount of $1847.44 for the moving of certain items belonging to Plaintiff Kathleen S. Sandnes of 228 Poplar Ave, New Cumberland, PA 17070. 4.) The agreement in question called for the Defendants' agents to pickup and transport various items of furniture from 24 Kingswood Dr., Lewisberry, PA 17339 to 228 Poplar Ave, New Cumberland, PA 17070. 5.) Contract also called for Defendant to perform these functions in a good and workmen like fashion and not to damage furniture or the premises during the course of its handling and transport. (See Attached shipping order Exhibit B) 6.) When said items were delivered to Kathleen S. Sandnes, 228 Poplar Ave, New Cumberland, PA 17070, on July 27, 2009 several items of furniture that were transported had been damaged. The damages in question aze as follows: A. Damage to one Tommy Bahama table and chairs. Damage to this item took the form of a broken leg to the table and chipping to the table's chairs. B. A Harden bed railing was chipped and gouged. C. A Crackle table had finished damage and damage to the chairs associated with the table. 5 D. Damage to the walls and ceiling of the property in doing the unloading and placement of the moved items to 228 Poplar Ave, New Cumberland, PA 17070, and related damage to the woodwork at the property. E. Damage to king sized Comfortpedic Mystere mattress cover. WHEREFORE, Plaintiff seeks judgement in amount of $9,064.38 necessary to repair and replace said items and damage. Nature of the damage to items as such that any attempt to repair the damage would diminish the value of the property in question and accordingly the replacement cost is sought. IN ADDITION, Plaintiff seeks the filing fee with the district magistrate and her other costs, (i.e. filing fees and related court costs as allowed in connection with the appeal to this Honorable Court.) Plaintiff further seeks compensation or remuneration for the time that she has expended gathering information assessing the damage to said property, the time expended in lodging and filing an appeal with the district justice and this appeal. Weaver & Son Inc. and Penn Hershey Transfer (PUC No. A-00113647 and in support thereof, alleges as follows: JURISDICTION This matter arises from an appeal from a judgement of the Honorable Charles A. Clement, Jr., Magisterial District No. 9-1-01. The notice of appeal was time of lodged with the Cumberland County Court of Common Pleas on 6/3/2010. PARTIES 1.) Plaintiff Kathleen S. Sandnes, an individual residing at 228 Poplar Ave., New Cumberland, PA 17070. 4 2.) Defendant Harrisburg Storage Company, Geo. W. Weaver & Son Inc. and Penn Hershey Transfer are businesses residing at 165 Lamont St., New Cumberland, PA 17070. BACKGOUND 3.) During July of 2009, Plaintiff and Defendant entered into a shipping agreement (Exhibit A) in the amount of $1847.44 for the moving of certain items belonging to Plaintiff Kathleen S. Sandnes of 228 Poplar Ave, New Cumberland, PA 17070. 4.) The agreement in question called for the Defendants' agents to pickup and transport various items of furniture from 24 Kingswood Dr., Lewisberry, PA 17339 to 228 Poplar Ave, New Cumberland, PA 17070. 5.) Contract also called for Defendant to perform these functions in a good and workmen like fashion and not to damage furniture or the premises during the course of its handling and transport. (See Attached shipping order Exhibit B) 6.) When said items were delivered to Kathleen S. Sandnes, 228 Poplar Ave, New Cumberland, PA 17070, on July 27, 2009 several items of furniture that were transported had been damaged. The damages in question are as follows: A. Damage to one Tommy Bahama table and chairs. Damage to this item took the form of a broken leg to the table and chipping to the table's chairs. B. A Harden bed railing was chipped and gouged. C. A Crackle table had finished damage and damage to the chairs associated with the table. 5 D. Damage to the walls and ceiling of the property in doing the unloading and placement of the moved items to 228 Poplar Ave, New Cumberland, PA 17070, and related damage to the woodwork at the property. E. Damage to king sized Comfortpedic Mystere mattress cover. WHEREFORE, Plaintiff seeks judgement in amount of $9,064.38 necessary to repair and replace said items and damage. Nature of the damage to items as such that any attempt to repair the damage would diminish the value of the property in question and accordingly the replacement cost is sought. Under the contracts between the parties Defendants had the right to inspect and repair this claimed damaged item which Plaintiff denied. C. Admitted the Crackle table and associated chairs had minor nicks and scratches. However, Plaintiff denied Defendants the right to inspect and repair these items which were repairable. Under the contracts between the parties, Defendants had the right to inspect and repair these claimed damaged items, which Plaintiff denied. D. Admitted that there were minor scuff marks on the walls, ceiling and woodwork of said property caused by transporting a mattress up the stairs of the property. However, Plaintiff denied Defendants the right to inspect and repair this claimed damaged property, which was repairable. Under the contracts between the parties, Defendants had the right to inspect and repair these claimed damaged items, which Plaintiff denied. E. Denied that Defendants caused any damage to the king sized Comfortpedic Mystere mattress cover. On the contrary Defendants caused no damage to the Comfortpedic Mystere mattress cover.
