WHEREAS DEREK B. NIXON entered into a contract with

to provide materials and/or to perform labor necessary for the construction and erection or the alteration and repair of
(a) building(s) ugon those certain pieces or parcels of land situated in SOUTHAMPTON TOWNSHIP
CUMBERLAN County, Pennsylvania, being more particularly bounded and described as follows:

preceding the recording of this stipulation to Derek B. Nixon.
NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said
contract and for the consideration therein set forth, that neither the undersigned contractor, any sub-contractor or
materialman, nor any other person furnishing labor or material to the said contractor under this contract shall file a lien,
commonly called a mechanic's lien, for work done or materials furnished to the said building or any part thereof.
This stipulation is made and intended to be filed with the County Prothonotary within ten (10) days after date, in
accordance with the requirements of Act of Assembly of Pennsylvania, in such case provided (49 P.S. 1402).

ALL of the following tract of land situated in Southampton Township, Cumberland
County, Pennsylvania, described as follows:
BEGINNING at a set iron pin at the southern corner of Lot 35 as shown on a final
subdivision plan for North Middle Spring Estates; thence along the western right of way
line of Walleye Drive, South 39 degrees 46 minutes 32 seconds West, 100.00 feet to a set
iron pin; thence along Lot No. 33, North 50 degrees 13 minutes 28 secons West, 169.05
feet to a set iron pin; thence along lands now or formerly of Wayne K. Wilhide and
Edithanne M. Beyer, North 39 degrees 54 minutes 18 seconds East, 100.00 feet to a set
iron pin; thence along Lot 35, South 50 degrees 13 minutes 28 seconds East, 168.82 feet
to a set iron pin, said pin being the piont of BEGINNING.
