AND NOW, this 9th day of June, 2010, after
conference with the parties, it appears that there are other
issues to be resolved in connection with the Charitable
Remainder Trust that was also created under the will. The
parties have agreed that the hearing on M&T Bank's Petition to
Terminate the Chapman Lodge Trust will be continued generally
and consolidated, to be heard with the other issues to be raised
in connection with the Charitable Remainder Trust.
