PLAINTIFF'S COMPLAINT NOW COMES Plaintiff, Louis J. Capozzi, Jr., by and through his attorney, Michael M. Jerominski, Esquire, and respectfully avers as follows: 1. Plaintiff, Louis J. Capozzi, Jr., (hereafter, "Plaintiff'), is an adult individual residing at 1655 Holly Pike, Carlisle, PA 17015. 2. Ronald and Darla Sharp are adult individuals residing at 14 Holly Court, Shippensburg, PA 17257, at which Service of Process maybe had upon Defendants Ronald and Darla Sharp. 3. On December 23, 2008, Defendant entered into an agreement to lease a dwelling located at 207 West First Street, Boiling Springs, PA 17007. 2 4. 207 West First Street, Boiling Springs, PA 17007 was owned by Plaintiff'. A copy of the Lease is attached as Exhibit "A" and is hereby incorporated by reference. 5. The condition of the property at move-in was "Excellent." Exhibit A at ¶ 12. 6. Defendants quit the premises on or about October 1, 2009, without notifying Plaintiff of their intention to do so. 7. In accordance with the terms of the contract, Defendants were to be solely responsible for "repairing any damage that is the fault of Tenant or Tenant's family or guests." Exhibit A at ¶ 15(C). 8. Paragraph 15(A) of the Lease states that tenant will, inter alia, "(1) Keep the property clean and safe (2) Dispose of all trash, garbage and any other waste materials as required by Landlord and the law (3) Use care when using any of the electrical, plumbing, heating, ventilation or other facilities or appliances on the Property... (4) Tell Landlord immediately of any repairs needed and of any potential harmful health or environmental conditions." Exhibit A. 9. Paragraph 15(B) of the Lease states that Tenant shall not, inter alia, "... (2) Destroy, damage, or deface any part of the Property or common areas...(4) Make changes to the property, such as painting or remodeling, without the written permission of the Landlord. Tenant agrees that any changes or improvements made will belong to the Landlord (5) Perform any maintenance or repairs on the Property unless otherwise stated in the Rules and Regulations, if any" . Exhibit A. 10. Paragraph 14 of the Lease states that Tenant shall be responsible for the payment of all utilities and services for the entire premises, with the exceptions of insurance and taxes. Exhibit A at ¶ 14. 11. Defendant has not paid South Middleton Township Authority monthly utility bills for water and sewer, for which they were responsible under the terms of the Lease and for which Plaintiff now must pay, which total $342.30. See Exhibit B. 3 12. At the time tenant relinquished possession of the property, the Plaintiff/owner discovered that the Defendants/Tenants had caused extensive damage to the leasehold premises. 13. The owner was required to hire outside contractors and did hire outside contractors in order to clean the property and make the property habitable and rentable. 14. The costs for labor and material required to make it habitable and rentable are shown on Exhibit C and total $5,229.51. 15. In order to clean, repair, prevent further waste, and ready the property to be leased to new tenants, outside contractors needed access to the property and its utilities. 16. The cost of electricity for the months from November 2009 and April 2010 total $742.59, as shown on Exhibit D. COUNT 1-BREACH OF CONTRACT 17. Plaintiff hereby incorporates paragraphs 1 through 16 of this Complaint as if set forth at length herein. 18. As more fully described herein, Plaintiff and Defendants executed the written contract attached hereto as Exhibit A (hereinafter "Lease") providing for the rent of the dwelling place at 207 West First Street, Boiling Springs, PA 17007 to Defendants by Plaintiff. 11. Through said Lease attached hereto as Exhibit A, Defendants agreed to pay for the rent of the dwelling at the rate of $1,200.00 per month, as set forth in Paragraph 6 of the Lease. 19. As per the Lease, Defendants were to be solely responsible for "repairing any damage that is the fault of Tenant or Tenant's family or guests." Exhibit A at ¶ 15(C). 20. As per the Lease, Defendants were not to "...(2) Destr oy, damage, ar deface any part of the Property or common areas...(4) Make changes to the property, such as painting or remodeling, 4 without the written permission of the Landlord. Tenant agrees that any changes or improvements made will belong to the Landlord (5) Perform any maintenance or repairs on the Property unless otherwise stated in the Rules and Regulations, if any" . Exhibit A. 21. As per the Lease, Defendants were to "(1) Keep the property clean and safe (2) Dispose of all trash, garbage and any other waste materials as required by Landlord and the law (3) Use care when using any of the electrical, plumbing, heating, ventilation or other facilities or appliances on the Property... (4) Tell Landlord immediately of any repairs needed and of any potential harmful health or environmental conditions." Exhibit A. 22. Plaintiff has been damaged by the Defendants' breach of the agreement and their failure to pay for utilities, repairs, labor, materials, and for the damage done by Defendants to Plaintiff's dwelling. WHEREFORE, Plaintiff respectfully requests that this honorable Court enter an Order as follows: a. Granting judgment for Plaintiff in the amount of at least $7,064.40, as shown below: 1.) Judgment for Plaintiff for Damages: $5,229.51 2.) Judgment for Plaintiff for unpaid water and sewer fees: $342.30 3.) Judgment for Plaintiff for unpaid electricity fees: $742.59 4.) Attorney fees: $750.00 b. plus prejudgment interest as called for in the Agreements and post judgment interest at the highest rate permitted by law, inclusive of interest and costs; c. Granting Plaintiff its expenses, including reasonable attorney fees as shown above that have been incurred in connection with this action, and; d. Granting such and other relief as the Court deems appropriate. COUNT 2-BREACH OF IMPLIED CONTRACT 23. Plaintiff hereby incorporates paragraphs 1 through 22 of this Complaint as if set forth at length herein. 24. At all times relevant hereto, the dwelling was habitable, with no complaint having been made by the Defendant. 5 25. Plaintiff s expectation of payment for services is reasonable and Defendants knew that it would be expected to pay for any damages caused. 26. Plaintiff has demanded payment form Defendant and Defendants have refused to render payment and continue to do so. 27. The facts, as set forth above, establish an implied-in-law and animplied-in-fact contract. 28. Due to the existence of the implied-in-law and implied-in-fact contract, the Plaintiff is entitled to compensation for damage caused to the dwelling by Defendants. 29. All payments, credits and offsets made by or owed to Defendant have been applied to Defendants' account to arrive at the amount due and owing. 30. Plaintiff has been damaged by the refusal of Defendant to pay rent for use of the dwelling, in breach of the implied-in-law and implied-in-fact contract in the amount of $7,064.40, plus prejudgment interest as called for in the Agreements, plus post judgment interest, if applicable. WHEREFORE, Plaintiff respectfully requests that this honorable Court enter an Order as follows: a. Granting judgment for Plaintiff in the amount of at least $7,064.40, as shown below: 1.) Granting such and other relief as the Court deems appropriate. COUNT 3-QUANTUM MERUIT 31. Plaintiff hereby incorporates paragraphs 1 through 30 of this Complaint as if set forth at length herein. 6 32. As more fully described herein, Plaintiffs expectation of payment in exchange for use of and damage to the dwelling was reasonable. 33. Plaintiff, in making the dwelling available and habitable to Defendants, has conferred a substantial benefit upon them. 34. Defendants retained the benefit of the bargain with the Plaintiff for the use of and damage to the dwelling and have not conferred a similar benefit in return upon the Plaintiff; as such, Defendants have been unjustly enriched at the expense of Plaintiff. 35. Due to Defendants' unjust enrichment, Plaintiff is entitled to proper compensation for the use of the dwelling by Defendants. 36. Defendants' unjust enrichment at Plaintiff s expense has damaged Plaintiff. 37. Plaintiff has demanded payment from Defendants, but Defendants have refused payment. 38. The Plaintiff has been damaged by the refusal of Defendant to pay for the use of and damage to the dwelling in the amount of $7,064.40, plus post judgment interest at the highest rate permitted by law. WHEREFORE, Plaintiff respectfully requests that this honorable Court enter an Order as follows: a. Granting judgment for Plaintiff in the amount of at least $7,064.40, as shown below: 1.)
