WINTON, Defendants COMPLAINT IN MORTGAGE FORECLOSURE AND NOW COMES PNC Bank, National Association ("Bank"), by and through its counsel, Tucker Arensberg, P.C., and avers the following in support of its Complaint in Mortgage Foreclosure: 1. PNC Bank, National Association, is a national banking association organized under the laws of the United States of America with a principal place of business at One PNC Plaza, 249 Fifth Avenue, Pittsburgh, Pennsylvania 15222-2707. 2. Defendants, Lee N. Winton and Tracey L. Winton ("Defendants"), are adult individuals whose last known address is 310 Tichy Drive, Mount Holly Spring, Pennsylvania 17065. 3. On or about October 2, 2007, the Defendants executed a Choice Home Equity Line of Credit whereby Defendants promised to pay to Bank the principal amount of $25,000.00 plus interest as provided therein as amended by an Amendment to Choice Home Equity Line of Credit dated October 2, 2007 in the amount of $55,000.00 (collectively the "Note"). A true and correct copy of the Note is attached hereto as Exhibit "A" and incorporated herein. 4. The obligations evidenced by the Note are secured by a Mortgage dated October 2, 2007 (the "Mortgage") given by the Defendants to Bank, encumbering certain real property located in the Borough of Mount Holly Springs, County of Cumberland, Pennsylvania, as more particularly BANK F1N:379053-1 000011-146162 described therein ("Premises"). The Mortgage was recorded on November 8, 2007 in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania in Instrument No. 200745704. A true and correct copy of the Mortgage is attached hereto as Exhibit "B" and incorporated herein. 5. The Defendants are in default of the provisions of the Note for failure to make payment when due and therefore the Defendants are in default of the Mortgage. The Note is due from December 15, 2009 and as of April 16, 2010 was past due in the amount of $2,077.89. 6. The Defendants are the record and real owners of the Premises. 7. There has been no assignment, release or transfer of the Note or Mortgage. 8. On or about February 16, 2010, Notices were sent to Defendants in accordance with 35 P.S. §1680.403C (Homeowner's Emergency Mortgage Assistance Act of 1983 -Act 91 of 1983) and 41 P.S. §403 (Act 6 of 1974) that an action on said Mortgage may be commenced after 31 days from the date of the Notices. Said Notices further advised Defendants of Defendants' rights and obligations in accordance with the Act. Copies of the Notices are attached hereto as Exhibit "C", collectively, and incorporated herein. 9. The amount due Bank under the Note and Mortgage as of April 16, 2010 was as follows: Principal $52 933.77 Interest through April 16, 2010 (continuing thereafter at $7.9393 per diem) 1,015.84 Late Charge 209.41 Attorneys' Fees 1,015.00 Costs to be added TOTAL $55,174.02 10. The total amount due to Bank under the Note and Mortgage as of April 16, 2010 was Fifty-Five Thousand One Hundred Seventy-Four and 02/100 Dollars ($55,174.02), plus costs and attorneys' fees. The Property was scheduled to be sold at the Cumberland County Sheriffs Sale on December 8, 2010 and was postponed to the March 2, 2011 sale date due to a voluntary moratorium on foreclosures imposed by the Plaintiff. 4. As of the date of this motion the voluntary moratorium on foreclosures is still in place. 5. Plaintiff is seeking an additional postponement of the Sheriff Sale to the June 1, 2011 sale date due to this voluntary foreclosure moratorium. 6. Plaintiff would be unnecessarily prejudiced if required to stay the writ and reissue a new writ for the purpose of new notice and advertising, as Plaintiff would incur new costs in excess of $1,500.00 along with continuing to carry the amount of principal and interest owed by the Defendants on the note and mortgage being foreclosed. 7. The Plaintiff believes and therefore avers that no other parties will be prejudiced by entry of this Order. 8. Pa.
