Sequence of events which led to the present appeal:
1 am Marc Schoen, of616 Erford Road, Camp Hill. The '97 Dodge Ram truck which is
at the center of this controversy is a necessary part of my business, Schoen Construction,
Inc.
In January,2004 the transmission on my '97 Dodge Ram tmck went out and I took the
vehicle to Charles Transmission at 48 S. 3M Street in Lemoyne for repair. Charles
Transmission is an auto repair business which specializes in transmissions. 1 paid
$2795.00 for the repair and an additional $129 for the warranty. The warrenty was for
one year or 12,000 miles.
I was assured when I went to pick up the truck that it was fixed and should be of no
further trouble.
Two weeks later, the new transmission failed, leaving me str:mded. This time the
defendant said he had found the problem and it would not happen again.
The third time the transmission failed was only a few days later. I was attempting to get
home as my fiance had been hurt and was being admitted to the hospital. Being stranded
by the side of the road during a snow stonn with a problem that should have been fixed,
was not helpful.
The defendant again assured me it could not happen again.
As the vehicle is used in my business, these additional breakdowns were inconvenient
and costly as my crew were forced to work around the loss of the truck.
The fourth time, I called Aamco transmissions service and th(iy successfully repaired the
truck on the first time. Please see their letter infonning me, that because the transmission
had not been properly repaired initially, this led additional parts to fail. The transmission
had to be rebuilt and they found evidence of die grinder marks on the front planet.
On March 19, I requested in writing, that Charles transmission refund my money, which
they have not done.
On the judgment of May 27,2004, the magistrate ruled thalt the defendant should refund
the total amount of$3101.00. During that hearing the defendant confessed that he
modified original parts, thereby causing future failure oftbe transmission
It is our contention that the defendant willfully violated stalldard procedures, failed to
meet his contractual obligation to make timely repairs and should refund the entire sum
as ruled in the judgment of May 27, 2004, plus the cost oflhe additional repairs and time
loss (of the vehicle) for a total sum $4,000.

I am Marc Schoen, of 616 Erford Road, Camp Hill. The '97 Dodge Ram truck which is

the total amount of$3101.00. This amount reflects the sum of $2795 minus $129.00 paid
to Aamco Transmission.
During that hearing the defendant confessed that he modified original parts, thereby
causing future failure of the transmission
It is our contention that the defendant willfully violated standard procedures, failed to
meet his contractual obligation to make timely repairs and should refund the entire sum
as ruled in the judgment of May 27, 2004.

13. We are considering this a statement- not an inquiry.
14. Our claim is that the Defendant was paid in entirety and on time for work
that was done on the truck that failed three times without giving the plaintiff
any compensation for lost time.
15. The Lemon Laws refer to new vehicles but not to repair or rebuilding. Our
protest was filed within the time limits.
16. We certainly did give the Defendant several opportunities to mitigate the
damages. Specifically, we gave the Defendant 3 opportunities to fix the truck,
as promised, we gave him the opportunity to lend us a rental vehicle which he
refused, and he was given an opportunity to refund our money when he failed
to fix the vehicle three times.

MOTION TO COMPEL ANSWERS TO INTERROGATORIES
Now, comes the plaintiff, Marc Schoen, to file this Motion to Compel Answers to
Interrogatories, as follows:
I. Plaintiff served upon Defendant Interrogatories on July 30, 2004. A copy of
those Interrogatories is attached hereto as Exhibit" 11:'.
2. At the time of service Defendant, through his counsel, was advised that this
information was necessary to pursue our appeal. No deadline was sent
as the counsel should have known the 30 day deadline.
3. The purpose for this motion to compel is that Defendant has filed an appeal to
the judgment rendered by the District Judge, Clement in the Plaintiff's favor,
yet denial of the information requested inhibits the Plaintiff from pursuing his
just claim. It is now three weeks past the deadline for response.
4. It is believed and therefore averred that absent an Order compelling a
response, Defendant will not provide the requested, and necessary,
information.
WHEREFORE, Plaintiff respectfully requests this Honoralble Court order Defendant to
provide full and complete responses to the interrogatories within fifteen (15) days of the
date of the order, or suffer the appropriate sanctions.

day of December, 2005, following a bench trial and
transcription of the record and lengthy consideration of the testimony adduced, the court
reaching the following conclusions:
I. The initial repair made by Charles Transmission, Inc., was adequate, particularly
given the use of the truck described by the plaintiff;
2. The second repair of the truck was necessitated by a problem having to do with a
valve controlling the flow of transmission fluid and not with the configuration of the planetary;
3. At all times the defendant was ready, willing and (contrary to the assertion of the
plaintiff) able to repair the transmission and to honor his warranty;
4. That it is incumbent upon the vehicle owner to give the mechanic "reasonable"
opportunity to make repairs in accordance with the warranty; and
5. That the burden of proving that he gave the defendant "reasonable" opportunity is on
the plaintiff and that burden of proof has not been met;
we are constrained to find in favor of the defendant and against the plaintiff and the complaint of
