Clement, Jr. Docket No. CV-OOOOI53-04 Date ofJudgment May 27,2004 Date of Rule to Appeal June 22, 2004 Sequence of events which led to the present appeal: 1 am Marc Schoen, of616 Erford Road, Camp Hill. The '97 Dodge Ram truck which is at the center of this controversy is a necessary part of my business, Schoen Construction, Inc. In January,2004 the transmission on my '97 Dodge Ram tmck went out and I took the vehicle to Charles Transmission at 48 S. 3M Street in Lemoyne for repair. Charles Transmission is an auto repair business which specializes in transmissions. 1 paid $2795.00 for the repair and an additional $129 for the warranty. The warrenty was for one year or 12,000 miles. I was assured when I went to pick up the truck that it was fixed and should be of no further trouble. Two weeks later, the new transmission failed, leaving me str:mded. This time the defendant said he had found the problem and it would not happen again. The third time the transmission failed was only a few days later. I was attempting to get home as my fiance had been hurt and was being admitted to the hospital. Being stranded by the side of the road during a snow stonn with a problem that should have been fixed, was not helpful. The defendant again assured me it could not happen again. As the vehicle is used in my business, these additional breakdowns were inconvenient and costly as my crew were forced to work around the loss of the truck. The fourth time, I called Aamco transmissions service and th(iy successfully repaired the truck on the first time. Please see their letter infonning me, that because the transmission had not been properly repaired initially, this led additional parts to fail. The transmission had to be rebuilt and they found evidence of die grinder marks on the front planet. On March 19, I requested in writing, that Charles transmission refund my money, which they have not done. On the judgment of May 27,2004, the magistrate ruled thalt the defendant should refund the total amount of$3101.00. During that hearing the defendant confessed that he modified original parts, thereby causing future failure oftbe transmission It is our contention that the defendant willfully violated stalldard procedures, failed to meet his contractual obligation to make timely repairs and should refund the entire sum as ruled in the judgment of May 27, 2004, plus the cost oflhe additional repairs and time loss (of the vehicle) for a total sum $4,000. The initial repair made by Charles Transmission, Inc., was adequate, particularly given the use of the truck described by the plaintiff; 2. The second repair of the truck was necessitated by a problem having to do with a valve controlling the flow of transmission fluid and not with the configuration of the planetary; 3. At all times the defendant was ready, willing and (contrary to the assertion of the plaintiff) able to repair the transmission and to honor his warranty; 4. That it is incumbent upon the vehicle owner to give the mechanic "reasonable" opportunity to make repairs in accordance with the warranty; and 5. That the burden of proving that he gave the defendant "reasonable" opportunity is on the plaintiff and that burden of proof has not been met; we are constrained to find in favor of the defendant and against the plaintiff and the complaint of
