THIS AGREEMENT made this ls~ day of ~arch, 2004, by and
between Premier Construction GrouD, Inc., of 39 S. York Road, Suite
A, Dillsburg, PA 17019, hereinafter referred to as Contractor,
ROBERT BLACK AND PAMELA R. BLACK, husband and wife, hereinafter
referred to as Owners, whereby the contractor undertook and agreed
to erected and construct a dwelling on the certain lot of ground
situate in UDDer Allen TownshiD, Cumberland County, Commonwealth of
Pennsylvania, and more fully described in Exhibit "A" which is
attached hereto and made a part hereof known as Lot #1 Bumblebee
Hollow Road, UDDer Allen TownshiD, Cumberland County, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00} Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

purposes therein contained.

Construction Group, Inc., and that he as such President being

ALL THAT CERTAIN tract or parcel of land situate in the Township of Upper
Allen, County of Cumberland, Commonwealth of Pennsylvania more particularly
bounded and described as follows to wit:
BEGINNING at a point on the western right of way line of Bumble Bee Hollow
Road T-614 Relocated (30' from centerline) at the dividing line between Lots gl and
#2 as shown on the hereinafter mentioned plan; thence along the western right of
way line of Bumble Bee Hollow Road T-614 Relocated South 21058'00" West a
distance of 342.29' feet to a point; thence continuing along the same by a curve,
curving to the left having a radius of 580.00' and an arc length of 118.38' feet to a
point at the intersection of the western right of way line of Bumble Bee Hollow Road
T-614 Relocated and the northern right of way of Old Hollow Road T-614
Relocated; thence along the northern right of way line of Old Hollow Road T~614
Relocated by a curve, curving to the right in a northerly direction having a radius of
120.00' feet and an arc length of 119.86' feet to a point; thence continuing along the
same North 20° 34'30" West a distance of 39.69' feet to a point at the dividing line
between Lot #1 herein described and lands now or formerly of Stanley F. Werzyn;
thence along said dividing line North 66°41'30" East a distance of 19.50' feet to a
point; thence continuing along the same North 51034'30'' East a distance of 91.51'
feet to a point; thence continuing along the same North 22°51'47" West a distance of
337.27' feet to a point; thence continuing along the same North 23005'53'' West a
distance of 85.98' feet to a point at the dividing line between Lots #1 and #3; thence
along the dividing line between Lots #1, #3 and #2 South 68°02'00" East a distance
of 362.99' feet to a point on the western right of way line of Bumble Bee Hollow
Road T-614 Relocated, said point being the Place of BEGINNING.
BEING Lot #1 as shown on the Final Subdivision Plan of Chad Hazam. Said Plan
being recorded in the Office of the Recorder of Deeds, Cumberland County,
Commonwealth of Pennsylvania in Plan Book 60, Page 4.
