THIS AGREEMENT made this 16th day of June, 2004, by and
between Renovations New and Old, hereinafter referred to as
Contractor,
Bradley Joe Kuntz and Heather Lydia Hoyer, single persons,
hereinafter referred to as Owner, whereby the contractor undertook
and agreed to erected and construct a dwelling on the certain lot
of ground situate in Dickinson Township, Cumberland County,
Commonwealth of Pennsylvania, and more fully described in Exhibit
"A" which is attached hereto and made a part hereof known as Lot #4
Myerstown & Goodyear Roads, Gardners, Cumberland County, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of {$1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

ALL that certain tract or lot of land situate in Dickinson Township, Cumberland County,
Commonwealth of Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a point within the intersection of T-524, also known as Myerstown Road,
and SR 3010, also known as Goodyear Road as shown on hereinafter mentioned
Subdivision Plan; thence along the centerline of T-524, also known as Myerstown Road,
South 35 degrees 13 minutes 44 seconds East, a distance of 240.90 feet to a point at lands
now or formerly of Donald C. Rice; thence along lands of Donald C. Rice and passing
through a st. pin set 25.32 feet from aforesaid centerline North 63 degrees 53 minutes 10
seconds East a distance of 420.75 feet to a st. pin set at lands now or formerly of Richard E.
Yeingst; thence along lands of Richard E. Yeingst, North 36 degrees 30 minutes 56 seconds
West, a distance of 244.20 feet to an I Bar Found, having passed through a st. pin set 53.69
feet from said I Bar Found and having crossed aforesaid S.R. 3010, Goodyear Road, at
lands n ow o r formerly ofJ ennie L. Kuhn; t hence a long lands o fJ ennie L Kuhn a nd
continuing within the right of way of S.R. 3010, also known as Goodyear Road, South 64
degrees 01 minutes 36 seconds West, a distance of 196.67 feet to a point at lands now or
formerly of Charles O. Marks; thence continuing within the right of way of S.R. 3010, also
known as Goodyear Road South 63 degrees 08 minutes 51 seconds West, a distance of
218.17 feet to a point, the place of BEGINNING.
BEING Lot No. 4 containing an area of 2.301 acres according to Final Subdivision Plan for
Michael T. and Lisa L. Rowe, dated October 29, 2003, prepared by John R. Williams, P.L.S.
and recorded in Recorder of Deeds, County of Cumberland, in Plan Book 89, Page 10.
