WBEREAS, Kenneth C. Black and Donna A. Black, Owners, are about to
execute contemporaneously herewith, a contract with J. W.Mumper
Construction, Inc., for the construction of a residential dwelling on Lot
%29, Wentworth Estates, Hampden Township, Cumberland County, Pennsylvania,
described in Exhibit"A" hereto attached.
NOW, ~j~_~, 2004, at the time of and immediately before
execution ~f the pti' ~cipal contract, and before any authority has been
given by the said Owners to Contractor to commence construction, or
purchase materials for the same in consideration of the making of the said
contract with Contractor and the further consideration of One Dollar to
Contractor paid by Owners it is agreed that no lien shall be filed against
said real estate or improvements erected thereon by the contractor, or any
subcontractor, nor by any of the materialmen or workmen or any other person
for any labor, or materials purchased, or extra labor or materials
purchased for the said construction, the right to file such liens being
expressly waived.

EXHIBIT "A"
ALL THAT CERTAIN piece or parcel of land situate in the Township of Hampden, County of
Cumberland and State of Pem~sylvania, lying at the northwesterly intersection of Claridge Court
and Heatherington Way, bounded and described as follows, to wit:
BEGINNING at the intersection of the northerly right-of-way line of Claridge Court (cul-de-sac)
with the line of division between Lot 29 mid Lot 28; extending (1) thence along Lot 28, North 57
10' 37" East, 200.00 feet; extending (2) thence along Lot 64G, South 32 49' 23" East, 75.00
feet; extending (3) thence along the same, South 54 33' 56" East, 143.98 feet to the westerly
right-of-way line of Heatherington Way (50 feet wide); extending (4) thence along said right-of-
way line by a curve to the left, having a radius of 665.00 feet, an arc distance of 124.27 feet, and
a chord bearing and distance of South 30 04' 51" West 124.09 feet; extending (5) thence along
the same by a curve to the right, having a radius of 25.00 feet, an arc distance of 37.46 feet, and a
chord bearing and distance of South 67 38' 58" West, 34.05 feet to the northerly right-of-way
line of Claridge Court (50 feet wide); extending (6) thence along said right-of-way line, North 69
25' 42" West, 77.21 feet; extending (7) thence along the same by a curve to the right, having a
radius of 475.00 feet, an arc distance of 132.76 feet, and a chm'd bearing and distance of North
61 25' 17" West 132.33 feet; extending (8) thence along the same, North 32 49' 23" West, 80.91
feet to the place of BEGINNING.
CONTAINING 1.079 acres.
SUBJECT to a twenty (20) feet wide storm drain easement as centered on course one (1) and
being contiguous and parallel to said line and extending between and extending up or contracting
to course (2) and course (8) of the previous description.
BEING Lot 29 as shown on a plan entitled "Final Subdivision Plan - Phase I, Wentworth
Estates" dated 11/20/2002, last revised 4/11/2003, Job Number 1001-846, prepared by LSC
Design, Inc., York, PA and recorded in Cumberland County Office of the Recorder of Deeds in
Plan Book 87, Page 50.
