STIPULATION AGAINST LIENS
THIS AGREEMENT made this ["1~ day of ,,~'-0r~., ,2004, by and between
Michael L. Martin, Inc., of Lewisberry, Pennsylvania, hereinafter referred to as Contractor, and
Mark D. Wilson and Jessie A. Wilson, of Camp Hill, Pennsylvania, hereinafter referred to as
Owner, whereby the former undertook and agreed to erect and construct a single dwelling house on
that certain lot of gronnd situate at 1424 Main Street, Lots 3 & 4 Yellow Breeches Farm, Lisbum
Road, Lower Allen Township, Cumberland County, Pennsylvania, a description of which is
attached hereto.
NOW THEREFORE, THIS AGREEMENT WlTNESSETH; that the said Contractor, for
and in consideration of the sum of One ($1.00) Dollar to Michael L. Martin, Inc., Contractor, in
hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration
mentioned in this Agreemem aforesaid for themselves and their subcontractors, and all parties
acting through or under them, covenant and agree that no mechanic's liens or cla'uns shall be filed or
maintained by them or any of them against the said buildings and the lot of ground appurtenant
thereto for or on account of any work done or materials furnished by them or any of them under
said contract or otherwise, for, towards, in or about the erection and construction of the said
buildings on the lot above described, and the said Contractor, for themselves, their subcontractors
and others under them hereby expressly waive and relinquish the right to have, file and maintain
any mechanic's lien or claims against the said buildings or any of them, and agree that this
instrument, waiving the right of lien, shall be an independem covenant.

LEGAL DESCRIPTION
ALL that certain piece of (and, situate in the Townships of Lower Alien and Upper Allen, County of
Cumberland, Commonwealth of Pennsylvania, being Lot Nos. 3 and 4 of the Final Subdivision Plan of
Yellow Breeches Farm, recorded in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania, in Plan Book 34 at Page 56, more particularly bounded and described as follows:
Lot No. 3: BEGINNING at a point being the northeast corner of Lot No. 4 on the aforesaid plan; thence
south 57 degrees, 00 minutes, 22 seconds east, a distance of 315.0 feet to a point being the northwest
corner of Lot No. 2 on the aforesaid plan; thence south 15 degrees, 13 minutes, 23 seconds west, a
distance of 728.59 feet along Lot No. 2 on the aforesaid plan to a point being the southeast corner of Lot
No. 2 on the aforesaid plan; thence north 57 degrees, 09 minutes, 53 seconds west, a distance of 315.0
feet to a point being the southeast corner of Lot No. 4 on the aforesaid plan; thence along Lot No. 4 on the
aforesaid plan north 15 degrees, 14 minutes, 38 seconds east, a distance of 729.42 feet to a point, the
place of BEGINNING.
SAID Lot No. 3 on the aforesaid plan contains 5.02 acres more or less.
Lot No. 4: BEGINNING at the northeast corner of Lot No. 5 of the aforesaid plan; thence south 57
degrees, 00 minutes, 22 seconds a distance of 315.0 feet to a point being the northwest comer of Lot No.
3 on the aforesaid plan; thence south 15 degrees, 14 minutes, 38 seconds west a distance of 729.42 feet
along Lot No. 3 of the aforesaid plan to a point being the southwest corner of Lot No. 3 on the aforesaid
plan; thence north 57 degrees, 09 minutes, 53 seconds west, a distance of 315.0 feet to a point being the
southeast corner of Lot No. 5 on the aforesaid plan; thence north 15 degrees, 15 minutes, 52 seconds
east along Lot No. 5 on the aforesaid plan a distance of 730.25 feet to a point, the place of BEGINNING.
SAID Lot No. 4 on the aforesaid plan contains 5.038 acres more or less and is subject to a 50 foot wide
drainage easement (see notes on the sub-recorded plan) along the east line adjacent to Lot No. 5 on the
aforesaid plan.
BEING the same premises which Keith E. Peifer and Saundra M. Peifer, husband and wife, by
their deed dated December 15, 2000 and recorded December 28, 2000 in the Office of the Recorder of
Deeds in and for Cumberland County, Pennsylvania, in Deed Book 236 at page 893, granted and
conveyed unto Mark O. Wilson and Jessie A. Wilson, husband and wife.
