HomeMy WebLinkAbout04-2828STIPULATION AGAINST LIENS THIS AGREEMEITT made the by and between WILLIAM H. GOODLING CONSTRUCTION hereinafter referred to as Contractor, AND WILLIAM M. GOODLING AND KELLY J. GOODLING, h/w hereinafter referred to as Owner, whereby the former undertook and agreed to construct single family dwelling, in LOT #47 WALMUT POINT, SILVER SPRING TOWNSHIP, PENNSYLVANIA, more fully described in attached exhibit "A", NOW THEREFORE, THIS AGREEMENT WITNESSETH : That the said Contractor, for and in consideration of the sum of OME Dollar to it in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said con tract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. GOODLING CONSTRUCTION : By (SEAL) (SEAL) (SEAL) ALL THAT CERTAIN Lot in the property known, na~ed and identified in the Declaration, referred to below, as "Walnut Point, a Planned Community," located in Silver Spring Township, Cumberland County, Pennsylvania, which has heretofore been submitted to the provisions of the Pennsylvania Uniform Planned Community Act, 68 Pa.C.S.A. ~ ~5101 et seq., as amended, by the recording in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, the Declaration for Walnut' Point, a Flexible Residential Planned Community ("Declaration"}, dated June 17, 1998, recorded June 18, 1998, in Miscellaneous Book 579, Page 882, as amended by First Amended Declaration for Walnut Point, a Flexible Residential Planned Community {"First Amendment"), dated November 1 ~, 2002, recorded November 14, 2002, in Miscellaneous Book 691, Page 3769 and as amended by Second Amendment to Declaration for Walnut Point, a Flexible Residential Planned Community, dated April 21, 2004, recorded April 22, 2004, in Miscellaneous Book 707. Page 3044, and designated in such Declaration as Lot No. 47 (identifying Number), described in Sect~om;2.2 of the Declaration, as amended and shown (and described) in Exhibit C~1 of the First Amendment. CONTAINING 0,3078 acres. BEING TIlE SAME PREMISES which Harold D. Stoner and Marilyn L. Stoner, h/w by their Deed dated~'~-~'~%- ~ ,2004 and about to be recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, granted and conveyed unto William H. Goodling and Kelly J. Goodling, h/w Mortgagors herein.
