COMPLAINT IN MORTGAGE FORECLOSURE
NOW, comes the Plaintiff by its attorneys, Vitti and Vitti and Associates, P.C. and
Louis P. Vitti, Esquire, and pursuant to the Pennsylvania Rules of Civil Procedure Numbers
1141 through 1150, for its Complaint in Mortgage Foreclosure, sets forth the following:
1. The Plaintiff is a corporation having a principal place of business located at
3232 Newmark Drive, Miamisburg, OH 45342. Plaintiff is successor by merger to National
City Mortgage a division of National City Bank.
2. The Defendant(s) is/are individuals with a last known mailing address of 28 W.
Pine Street, Enola, PA 17025. The property address is 28 W. Pine Street, Enola, PA 17025
and is the subject of this action.
3. On the 23rd day of May, 2008, in consideration of a loan of One Hundred Forty-
Two Thousand Three Hundred Fifty-Three and 00/100 ($142,353.00) Dollars made by
National City Mortgage a division of National City Bank to Defendant, the said Defendant
executed and delivered to National City Mortgage a division of National City Bank a "Note"
secured by a Mortgage with the Defendant as mortgagor and National City Mortgage a
division of National City Bank, as mortgagee, which mortgage was recorded on the 28th
day of May, 2008, in the Office of the Recorder of Deeds of Cumberland County, at
Instrument No. 200817662. The said mortgage is incorporated herein by reference thereto
as though the same were set forth fully at length. The Plaintiff is the legal owner of the
mortgage and is seeking enforcement of the mortgage through foreclosure.
4. The premises secured by the mortgage are:
SEE EXHIBIT "A "ATTACHED HERETO.
5. Said mortgage provides, inter alia:
"that when as soon as the principal debt secured shall become due and payable,
or in case default shall be made in the payment of any installment of principal and
interest, or any monthly payment, keeping and performance by the mortgagor of any of
the terms, conditions or covenants of the mortgage or note, it shall be lawful for
mortgagee to bring an Action of Mortgage Foreclosure, or other proceedings upon the
mortgage, of principal debt, interest and all other recoverable sums, together with
attorney's fees."
6. Since December 1, 2009, the mortgage has been in default by reason, inter
alia, of the failure of the mortgagor(s) to make payments provided for in the said mortgage
(including principal and interest) and, under the terms of the mortgage, the entire principal
sum is due and payable.
7. In accordance with the appropriate Pennsylvania Acts of Assembly and the
Pennsylvania Rules of Civil Procedure, the mortgagor(s) has been advised in writing of the
mortgagee's intention to foreclose. The appropriate time period has elapsed since the
Notice of Intention to Foreclose has been served upon the mortgagor(s).
8. The amount due on said mortgage is itemized on the attached schedule.
9. Pursuant to Pennsylvania Rule of Civil Procedure 1144, the Plaintiff releases
from liability for the debt secured by the mortgage any mortgagor, personal representative,
heir or devisee of the mortgagor who is not a real owner of the property at the time of the
filing of this Complaint.
WHEREFORE, pursuant to Pennsylvania Rule of Civil Procedure Number 1147(6),
Plaintiff demands judgment for the amount due of One Hundred Fifty-Eight Thousand One
Hundred Twenty-One and 82/100 ($158,121.82) with interest and costs.

LEGAL DESCRIPTION
ALL that certain piece, parcel and tract of land situate in East
Pennaboro Township, County of Cumberland, Commonwealth of
Pennsylvania, bounded and described as follows:
BEGINNING at an iron pin on the Southern right of way line of West
Pine Street (also referred to as Pyne street) being the dividing line
between Lots 1 and 2 as shown on the hereinafter mentioned plan, said
point being referenced North 75 degrees 40 minutes 00 seconds East, a
distance of 155.00 feet from the Eastern line of a 1S foot wide alley
as shown on the Plan of Adams and Pyne, recorded in Plan Book 1, Page
17; thence along the Southern right of way line of Nest Pine Street
North 75 degrees 40 minutes 00 seconds East, a distance of 70.00 feet
to a concrete monument at the dividing line between the herein
described tract and land now or late of Ronald G. Gates and Donna L.
Gates; thence along the western line of said lands of Gates South 14
degrees 20 minutes 00 seconds East, a distance of 150.00 feet to an
iron pin on the Northern line of a 15 feet wide alley (unopened);
thence along the Northern line of said alley South 75 degrees 40
minutes 00 seconds Nest, a distance of 70.00 feet to an iron pin at
the dividing line between said Lots 1 and 2 aforementioned; thence
along the dividing line between said Lots 1 and 2 North 14 degrees 20
minutes 00 seconds Nest, a distance of 150.00 feet to an iron pin on
the Southern right of way line of Pine Street, said point being the
place of beginning.
CONTAINING 10,500 square feet.
BEING Lot No. 2 as shown on the Final Subdivision Plan of Central
Penn Properties recorded in Plan Book 69, Page 119.
BEING referred to as all of Lots 69 and 70 as the Eastern 20 feet of
